This should point you in the direction of the obvious parts of the NtK which are non-complaint.
Again though - be careful to adopt the correct information regarding the alleged charge, location, presence of signage, etc.
Also, here (http://www.legislation.gov.uk/ukpga/2012/9/schedule/4/enacted) is a link to the actual legislation, which I have copied from the *NEWBIES* thread for you so it's easy to find. It's sadly written slightly in legalese, but the relevant parts for your purposes (Paragraph 9, Clause 2) is a bullet point list that is fairly straightforward. All you need to do is check to make sure every bullet point is covered.0 -
Just had a reply in the post about the parking charge i received after responding to them.
It says in light of your claims the representation stated in your appeal have been noted and upheld.
We apologise sincerely for any inconvenience and can confirm this Notice has been cancelled in full and no further action will take place on this occasion.

We have also fallen foul of failing to realise that this was a pay and display car park, being visitors to the area who just dropped into Lidl a few weeks back for some shopping while on holiday.
After 4 weeks away we just came home to this "charge notice". At first we could not even think where the car park was as the notice stated only "The Broad Centre".
Never been in a Lidl car park in UK or anywhere in Europe where we were required to pay, and never noticed any signs saying there was a fee to park there.
From Googling, we see that the charge was apparently £1, which is refunded if you shop in Lidl. We saw no signs in Lidl to this effect.
Looking at this POFA (2012) thing, we are unsure exactly which bits of paragraph 9, clause 2 the Charge Notice does not comply with. Never been involved in anything like this before!
Any help would be appreciated.0 -
