Contract Renewal

Can you settle an argument for me please?

Contact renewal for a tenancy, can the wording of that contract be altered if it is between the same parties or does renewal mean 'same contract, just extended'?

  • 'renewal' actually means agreeing to a brand new, separate tenancy and therefore all the terms may change if the parties agree.
  • if you do nothing it becomes a continuation of the previous agreement but (normally) requiring 2 months notice to quit from either side, this is a periodic tenancy. The initial let is usually fixed term. If you issue and tenant agrees to, a new contract, then yes it could be completely different.
    Mr Generous - Landlord for more than 10 years. Generous? - Possibly but sarcastic more likely.

    Depending on why you are asking the question - you can make the wording more explicit, if you want to. For example, "Contract renewal on the same terms as the current contract".
  • I think I've got the answer. But yes, to be clear it is a new document that would be signed by all parties. (ie; at the end of the year term, for tenants to remain in situ). So, in essence it's a renewal of the same tenancy but with one or two added clauses.

    The agents have snuck in a renewal charge, that's the biggest issue. - I didn't know, neither did anyone else, apparently.

    Then try and negotiate it out/down before you sign. Although your last sentence leads me to think you may have signed before you read it!
