Is it a private road?

Options
Hi all,

I parked on a road which has no lines on it, but is supposedly private land, signed by UKPC. The short road is actually the entrance to a housing estate, which has private numbered bays etc in it. I never considered parking in those bays, but the 'offence' states that I have "Not parked correctly within the markings of the bay or space". I want to write to UKPC with the first offence line, but no idea if they're gonna go for it. I also want to tell them it's not a private road, but no idea how to find that out.

Could anyone help with advice - it would be greatly appreciated!

    More info needed.

Did you get a windscreen ticket?

Is there any signage at the start of the road indicating that it is private land and that terms and conditions apply?

No offence has been committed! You have just broken one of their silly rules that are in place for people to transgress and earn them income.

Have a good read of the Newbies thread.

There are a number of new builds where I live that are infested by UKPC by the developers, they like to keep the roads clear as it tidies up the estate and helps with sales.
No thought of course to the poor suckers they have already sold to, or the delivery drivers and contractors they subsequently mug in the process.

You have not committed any "offence" you have a speculative invoice from greedy Muppets that have also been proven to employ liars and use dodgy letters to bend the truth to extract money from victims.

You need to read the newbies start here thread, don't name the driver, never phone anyone connected with them, and your "first offence" idea will be laughed at, as they chuckle and think sucker lets go for the kill!
  • Hi guys

    Thanks for the responses.

It was a windscreen charge notice, and there is signage at the front of the road saying Permit Holders Only.
The advice on the template letter mentions 'first offence' as a mitigating circumstance, it doesn't sound right though!
  • Check with the planning department of the council area the road is in, they should be able to give these details.

Are you sure you have the correct template? There is one in the "official" MSE parking page that is less useful than a chocolate firebrick.

The template you want is the one in the Sticky thread for NEWBIES for BPA members and it is the only one in blue text.
Copy and paste and send around day 25 if online or day 22 by post, first class from a Post Office and get a free proof of posting. Do not edit.

Meanwhile check with the council as already advised to see if the place you parked is indeed private land.

I certainly do not mention that in the NEWBIES thread!

Sounds like you've been reading the still fairly AWFUL MSE 'advice' about appealing a parking ticket which has a template including the shoot-yourself-in-the-foot phrase :

'The reason I parked where I did was...' !!

I did advise MSE Megan last month when she emailed me to ask about the newer version template, that that phrase above all others, MUST be removed from the guide! ONLY read the NEWBIES thread to find the appeal for a private parking ticket. Forum advice only, not MSE articles.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

  • Hi again,

    Thanks for the clarifications.
About to write the letter, and looked at the ticket again, they haven't even got the Location road right, mentioning the main road (public highway), so that makes things nice and easy.

Having said that, UKPC also control the car park for my block of flats, and have just given me a ticket for using my own parking spot. Charming.
  • Don't reply to them, just ignore anything you get from them, unless recorded delivery of course

    re, own space:
    A few questions...
1 what does your lease,/rental/free hold/ast day about parking, and the assigned space?

2 why are you displaying a permit to park in that space?

3 are you happy that a third party, such as a management company is in effect sub letting your suave to a profit driven company to monetise for their own gain?

4 if you are happy to display a permit to park in your own space, would you also accept a permit to open your window/a window after 10pm at night or pay a window opening fee of £100 (discounted to £75 for early payment)?

    Hi Half_way

Ok, I'll admit, it was the Mrs who got the ticket. we've been allocated a space which we share. She doesn't display the permit, I don't either. We've only been there a month, so I've not been ticketed as yet.

Edit: I've just spoken to my management company, who are just saying 'you have to display the permit'.
So being happy or not doesn't matter a jot, when the entire country has been sublet to profit driven companies!
