Currys refusing return of 1 Day old £2000 TV bought online

    They'll probably just deduct return postage of about £30 or so fully insured

    No such thing as partial refund, it is all or nothing.
    Refuse to accept any partial refund.
    yes there is, not saying it applies here but there is definitely scope for a partial refund if the circumstances warrant it.

    Further to what other posters have said, they can only deduct anything if your handling goes beyond what was necessary (as per the part wealdroam quoted) AND if they provided you with the necessary information - and the burden is on them to prove they complied rather than on you to prove they didn't.
    (9) If (in the case of a sales contract) the value of the goods is diminished by any amount as a result of handling of the goods by the consumer beyond what is necessary to establish the nature, characteristics and functioning of the goods, the trader may recover that amount from the consumer, up to the contract price.

  • You should definitely take pics. Traders know of these regs but hope that customers don't, it makes their lives much easier.

    Stick to your guns and quote the relevant regs, and at the outset ask for the call to be recorded....for training purposes!!
  • Just thought I'd add an alternative experience to this thread, since I found this when searching for advice on the subject. I bought a 49" 4K TV from Currys last Sunday. In the shop, the display looked good and clear. I knew it was cheap in comparison to other TV's but thought the picture was great. Getting it home, I soon changed my mind. I assume the store demo focusses on certain 4K aspects that made the TV look good but, in reality, in 'real world' usage where most channels/programmes are not in 4K, my new JVC TV was woefully inadequate as a replacement to the 5/6 year old Samsung HDTV.

    I tried to put up with it for a couple of days but decided that I just couldn't. I phoned Currys customer services and told them the situation. They said that, because I had only recently bought it (I think 'within 7 days' was significant here) I should be able to return it. They also said, of course, I would have needed to open it up and try it out before knowing if it is OK for my needs.

    I took it back to the store on Friday. I'd packaged it up as best I could. I don't know if they even looked inside the box. They certainly didn't try it out to make sure it still worked. They just accepted what I said, no problem. I'm sure it helped that I said that I didn't want a refund, I wanted to exchange it for a better (ie more expensive) one.

    Picked out a different telly, paid the difference (so, no partial refund), all went well. So, Currys PC World do get it right sometimes!

    It does show how things have changed since the olden days though. I'm old enough to remember when Currys where like that.
