Until you see the road in question I'd refrain from making comments or judgements on driving quality, as a professional driver holding every single licence (apart from motorbikes) I think I can make a fair judgement on driving quality.
Even if guidelines have not been breached the council have been negligent by not reporting the hole themselves, they had been repairing sections of the road either side of the damn thing! And it wasn't contractors either, it was Powys County Council highways themselves on site.
Hopefully the road repair history dates will show this.
Did YOU manage to drive along the road and avoid the hazard without damage to your vehicle. How often have you done so in the last month? If you observed the road damage did you report it?0 -

Why do some people bother posting on here and ask for advice or opinions if they have already made their mind up before posting and only want replies that agree with them?
Unless you can prove that the council were aware of the pothole in question and failed to act on the report, thus showing that they were negligent, your partner has little or no chance of getting anywhere.
As you drive on the road in question "almost every day" and hadn't previously spotted such a big hole, maybe it only appeared a few hours before the incident in which case, there is nothing that the council could have done.
It may have been caused by a bit of subsidence or water erosion in the road foundations hence the reason for the sudden appearance.0 -

Oddly enough the date we bloody spotted it! Which incidentally was when I drove up the road to see what it was she had hit.
How did you manage to find the hole if it was filled with water?
The point I'm making is that given the heavy traffic on the road, the appearance of potholes is fairly likely and seeing a 'puddle' in the middle of the road would be an obvious sign of potential trouble. You spotted it because you were alert to the danger.
I'm a regular user of roads near the quarries in buxton and I always assume any puddle on the road is concealing a pothole of unknown depth, because they usually are.0 -
The council (or responsible body for that stretch of road) does not necessarily have to be aware of the defect to be liable for any damage.
They are duty bound to inspect the road and to log such inspections.
I would suggest that you request the inspection log and report and see whether they have fulfilled their obligations.
My partner won a £350 claim for a new tyre and wheel against the County Council as their inspection logs failed to show that the section of road concerned had been inspected at all.0 -
