We have received two parking charge notices for different vehicles.
First vehicle: incident date 03/06/16, PCN issue date 04/07/16 it's a final reminder dated 05/08/16.
Second vehicle: incident date 03/06/16, PCN issue date 30/06/16 it is also a final reminder dated 02/08/16.
We have then received a letter before action for both dated 06/09/16 and 12/09/16 from Civil enforcement Ltd. We did not receive any letters previous to these.
The reason I am asking now is because we have moved out of the house these letters were sent to and I think the only reason the new owner has contacted us is because they saw 'letter before action' through the envelope window. Is it too late to appeal? Should I pay them? I have tried reading some posts but I'm finding it very confusing! Thank you.
I should add that they were on different car parks, I was the driver of one (not the registered keeper).

    The UK Government says you should be able to appeal for up to one year after the alleged event.

    I suggest you find the relevant parts of that legislation, quote it to the scammers, and send the appeal template you will find in the Sticky thread for NEWBIES.

    Do not reveal who was driving. You should not mention that in your post above.

    You appeal as keeper (of the keeper on the day of the alleged event) in all cases. I have amended my quote where you have mistakenly put in the incorrect information about this. (Last line.)

    Right so you need to respond to the LBAs but do NOT say who was driving. The registered keeper replies robustly like here (different parking firm):

    You blew it by not getting your post redirected so you could have appealed. Why do people not spend a few quid on six months mail redirection by the POst Office?! We do beat every Civil Enforcement PCN on here with two appeal stages, because as keeper you cannot be liable.

    That will also form part of your defence (registered keeper's name) as and when you get a claim.

    You can do this but you need to be more:''Mr Angry but well informed'' and try to see it off by responding to the letters and demanding evidence of a contract (NOT saying who parked & what happened!!).

    I'm trying to understand, how did you miss a Notice to Keeper and reminder x 2 dated July/August then?

    No-one is telling you to pay these...hope you understand this from the outset.

  • The initial letters must have been sent as the redirection was ending, I'm trying to find the date of it finishing. The new owner put these letters back in the post box I believe but they kept being sent back. There was no notice to keeper or a previous reminder to the one we have so I don't know if the new owner threw them or didn't receive them.
    I appreciate your help anyway, I'll take a look.

    No ticket left on the vehicle I was driving and I'm pretty sure there wasn't on the other vehicle as my husband would of given it me to sort out anyway! So what does this mean? Thank you

    It means only the Driver can be liable and CEL will have to prove who the driver of each vehicle was. (Which is why you never admit who the driver was)
  • I've never had to deal with this before and I haven't got a clue what any of it means so thank you! The other vehicle is a works van so I haven't got a clue who was driving that anyway and I doubt they'd remember from June!

    OK - in fact, EVERYONE who comes here is in the same boat as you and they do win appeals (too late for 'appeal' your case but that doesn't stop a robust response from the registered keeper denying liability, etc.). We have people here with court threats and claims re parking tickets from five or six YEARS ago, never mind 3 months but yes, your point is valid, the keeper can't be expected to remember.

    So read other threads and be ready for a possible claim to defend (NOT a reason to pay).
