    The IPC CoP would be irrelevant in this case ... UKPC are BPA members. ;)

    Damn! You've got me there! I'd got it in my head they were IPC.

    Does the BPA CoP not same the same thing somewhere?

    They then say it's advisory not compulsory, or whatever other excuse fits, remember its a trade club not a regulator, and all trade organisations bend towards their paid up members.
    While their PR machine manipulates their public face to seem like a fair minded middle of the road liaison body.

    All founded on good quality bovine detritus.

    Hi All,

    it is about time to send the first appeal. I am wondering if it is better to appeal online or appeal via post? I do not think i will be able to have any proof that the appeal was sent if i do it online.

    I was previously told to use the template in blue in FAQ's section so i am wondering if this is the correct template i should be using:

    Dear Sirs

    Re: PCN No. ....................

    I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.

    I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers before they park.

    Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. I believe the driver may well be eligible for cancellation and you have omitted clear information about the process for complaints including a geographical address of the landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    I have kept proof of submission of this appeal and look forward to your reply.

    What does the NtK say about submitting an initial appeal? You should follow that to the letter (including providing your name and address) - it gives the PPC no scope to ignore the appeal on the grounds that you didn't follow their process.

    It it's an online appeal, take a screen shot of it just before pressing the 'send' button. Lots of PPCs use an auto-reply to confirm receipt.

    If it's email, send a bcc to another email address you have, or to a trusted friend.

    If it's snail mail, then via the Post Office counter asking for a free 'Certificate of Posting' to prove despatch (not Recorded/Signed For).

    But, the important thing is you follow the PPC's instruction - and never identify the driver!

    Appeal has been sent using the template and me providing a copy of a receipt from one of the retail park stores (to prove that the driver was a customer while the PNC was being issued).

    Will let you know of the result in the months time :)
