    That's IF the car wasn't being driven by an employee of Hertz. If it was, then the last person to hire it is going to get shafted and the person driving will get away with it, which would explain why they drove off and left the scene of an accident.

  • IF it was an employee I have the photo of both driver and passenger so that won't be an issue but highly unlikely to be an employee as I have been to the depot it was hired from to check it out the car was not there, the depot manager confirmed it was on hire but that was all he could tell me and that no accident had yet been reported that was on Monday but my insurance have sent over claim details yo Hertz insurance just waiting a response
  • Hi, still nothing back from third party I think they allow 21 days for them to acknowledge receipt of a claim??
    But from the guy at the depot I spoke to he did let slip that the car was reported stolen but the report was received after the accident took place??? Alarm bells!!
    If the car was reported stolen what would the third party insurers do as the car was driven by someone who apparently had 'stolen' it if they are caught or not caught by police? If that is the case where would that leave me would the hire company reject the claim on the grounds it was stolen ..etc I'm only third party so can't claim off my own insurance, how would this be dealt with?

    From what you have said, you have sufficient evidence the accident was caused by the 3rd party.

    Herts and most other car hire company's will have a process in place to deal with their cars involved in an accident, as it happens quite often.

    Take up contact with the Head Office @ Hertz and speak to someone who deals with the accident/claim side of things. It is in there interest do deal with you directly, as if you involve your insurance, 3rd Partys Cost will go up.

    Also consider speaking with a Claim / Solicitor firm who deal with insurance claims, they will happily take on a claim especially a non fault and probably wont charge you as they will invoice the 3rd Party to cover their own costs.

    AFIK, if a vehicle is stolen the insurers of the vehicle are still liable for damage caused by their vehicle.

    The "insurance handling company" who should be acting on your behalf appear to be dragging their feet. What are they doing to expedite? It seems you have a solid case or they would not have taken your case. They should have arranged a free hire car for you.

  • They have told me they have submitted my claim to Hertz insurance company but as its all electronic via a portal I'm told the third party have 21 days to acknowledge receipt of a claim and to put across their position accept/deny liability. The claim was only submitted to third party on the 12/09/16 so I'm told they have done their bit by notifying the third party insurer and they are currently waiting in their position with liability.
    My only concern was if the car was 'stolen' would the third party insurers deal with this as they could say whoever stole/drove the car at the time of the accident was not insured ??? I just really don't Know...surely of the car was stolen the police would of got back to me with some information ..

    Quick update, third Party have finally paid out, apparently had a back log in cases no dispute over claim, Great!

    Just as an aside to this thread and picking up on this point.

    A few years ago on my motorcycle I was hit by a driver who had 'borrowed' her boyfriends company van, she had a provisional licence, and didn't have her own insurance.

    Once I got up the police turned up and took statements, they then confirmed that the vehicle had been 'borrowed' (technically Taken Without the Owners Consent 'TWOC' or stolen). Even though the vehicle wasn't being driven by an authorised driver the companies insurance company was still liable and paid out. It is then up to them to recover the money from the driver.

    The reason the boyfriend probably admitted his girlfriend had taken it without permission is that it is also an offence to allow a non-insured driver to drive a car, so he would have been prosecuted along with her and probably lost his job too.
