I Just wanna test drive it legally

I don't blame you. Tell the sellers that unless you are able to do a decent test drive that you'll look elsewhere. I know they said they would MOT it on payment of a deposit, but would that deposit be refundable if you chose not to go ahead with the purchase?

If they might want to buy it they shouldn't place a deposit down... The nature of the deposit is that a contract is being entered in to.

I wanna test drive it before I put a deposit down to secure the car & have time to get the insurance/tax ready to drive it away once I paid the rest...

No point doing insurance/tax if you might not buy the car.

I don't wanna pay a deposit then test drive car and not like it...

They said they will do new MOT on Car once you you have bought it or put deposit down

In spite of the NB do you know how serious the offence you are committing in encouraging someone to beak the law is? Quite telling that "knowingly" you have here. It doesn't absolve you.

Now your post may not have been intended to encourage the OP commit a criminal offence but it certainly can be read to be so.

If I were encouraging him/her - which was not my intention - then yes, I do know how serious it is. The penalty for assisting or encouraging is the same as that for the underlying offence.

Indeed - it would carry exactly the same number of points. Zero.

Indeed, but you could enter a clause yourself stating that the deposit is refundable if you are not satisfied with the car on test driving it. Up to the seller whether they agree to it, but contract terms can be set by both parties.

If your not willing to bend some rules and test drive with no mot then walk away.

You can try ask for terms as above, but either the dealer will agree then go back on it or won't agree. Afterall what would be the point of a deposit in the first place if it was agreed you could back out anyway. Dealer is trying to remove the risk of spending money on it for it to be sat there for another 6 months... Such a term doesn't work for him.

depends whether the dealer also has the ability within the premises he owns that can do MOTs. Many do, and so therefore the cost would be minimal to do a further MOT test as necessary.

All I wanna do is look at the car/test drive it legally. I don't wanna pay any deposit/buy the car until I am satisfied that the car is 100% problem free and I am happy with it

Well you have a choice to make, test drive it without a mot or look for another car.
