Indigo Hospital site, Multiple fines
Comments

It sounds like all the nurses working at this Hospital need a staff meeting to discuss the issue of parking. I am sure it does not benefit herself when she has to 'abandon' her vehicle in the car park to urgently take up her duties. Get the line managers to decide what is the best action to take in these circumstances and if she has to tend to her car, then so be it.0

The Hospital will have a Travel Plan - including details of "fines" - so see if she can get a copy of that. She can also get a copy of the contract between Indigo and the Trust - assuming it is not a PFI site. Both will be a lot of help in sorting this out. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
Hey everyone
Thanks again for the advice.
She got this email on Friday. So has 14 days to sort it out from then.
SRA rejected the request.
She's basically given up and cbb with fighting!
Enclosed is the email:
First of all, please note letters and communication issued by Wright Hassall are done so in accordance with Annex B of the Pre Action Protocol. Please refer to point 1 regarding the Letter Before Claim. We are happy that we have not misled any party.
Secondly, we currently hold xx Parking Charge Notices (PCNs) that have been issued to your vehicle XXXXXXX for breaching terms and conditions of the parking site in question. Please note being an employee of XXXXXX does not exempt you from parking in breach of the parking terms. Therefore, our clients have confirmed the xx PCNs have been issued correctly and that you will remain liable to the outstanding balance above.
Moreover, this matter has now progressed to recovery stage and you have surpassed the time to appeal the above PCNs. Therefore, to close the matter in settlement of your liability, the outstanding balance of £xxxx00 needs to be paid in full. We will place a further 14-day hold on this matter to allow you time to make payment. Should payment not be received, the hold will be removed and this account may proceed to litigation stage.
Please see below our payment methods we have enclosed for your convenience.
Any advice? She's basically given up and wants to pay.
Thanks

As IamEmanresu said, get the NHS Travel Plan. Don't pay this!jumbotron117 wrote: »

What do you mean by this, 'SRA request'? There was to be no request to the SRA - a major complaint yes but not a request?SRA rejected the request.
I'll reiterate my advice from earlier - I assume she's looked at the NHS Parking Principle (Google it, the Government set that code and it covers unfair treatment of staff as well):She should respond with more than that to a Letter of Claim...has her reply been sent yet?
Write for the Judge who'll see this exchange of letters later. So she should be saying more, things she wants a Judge to see, such as:
- taking a doctor or nurse (or patient) to court is outwith the Government's NHS Parking Principles.
- penalising patients or staff with 'fines' where a third party profits, is categorically against the same policy.
Ask WH why they are threatening NHS staff members and suggest they read the NHS Parking Principles without delay because they are about to embark on ill-advised litigation. And tell them that they have been reported to the SRA for misleading an unrepresented consumer by suggesting that they can merely 'seek' and then enforce with bailiffs or attachment of earnings orders, a CCJ as if it is inevitable.
Their letter misstates the position which of course does not automatically result in an order nor necessarily wreck credit for 6 years. There is the small matter of a defence and a hearing...and if she loses she gets no CCJ/bailiffs or any repercussions if she lost but THEN paid.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
