Residents parking going to premier parking solutions!!

Hi everyone, hope you had a good summer. Looks like it's over here in Torbay. We live in a house with a residents parking area which is used by both our row of houses and a block of 14 flats opposite us. According to neighbours it's been that way for around 30 years.

The development we've got is that the property management company Blenheims have decided that the houses will no longer be able to use the car park and only the flats will have spaces for each flat (it's all been pretty casual up until now without that many problems apart from the usual couple of complainers etc)

The main problem with that is going to be people having to find parking away from their houses and walk up a pretty steep hill to get to their own house, while the carpark sits half empty as a lot of residents don't drive! Especially after 30 years of the same situation.

I was hoping for some advice as to weather they can do it or not? It's privately owned land so I presume they can do what they want. It just seems like a pretty silly decision, especially as I've offered to buy a permit for our house and even contribute to the cost of re surfacing the road in exchange for a permit. Don't think I could have been fairer really. Also when Premier Parking take over in October will I be able to ignore the fines or would it be a bad decision.

  • What do your deeds/lease say about parking. My daughters deeds actually show a map of the parking spaces.

  • The deeds for the plot of land including the car park shows the spaces allocated for the flats which are numbered for each resident. There are 5 other spaces that were, according to neighbours made for the use of the houses but there's nothing written in the deeds about them and they're not even shown on the deeds as if they're not there! I'm hoping that could be our loophole.

    not the ideal solution for everybody ..... but, if the change can not be stopped ....

    could you not buy / rent a space from a flat tenant who does not need one ?

    Club together and get a solicitor to check the leases. What it costs now may save a lot in the future. PPS will not stick around if there are no victims.

    In answer to your question about what to do if you get a PCN, do NOT ignore. This has been bad advice since the law changed in 2012.

    It may be worth looking at the planning permission for the flats. If the houses pre date the flats, and the flats were awarded permission on the proviso that an area would be set aside for local/resident parking then any permit scheme would be for want of a better word stuffed.

    The main problem with that is going to be...residents and visitors will be fined by PPS and then dragged to court.

    I just put right your description of your 'main problem'.

    Sorry but (as you suspect) it will be a disaster and you cannot ignore these parking charges now. Not only that, as PPS are not in the BPA, there is no POPLA, NO APPEAL WORTH TRYING.

    Club together with the flat owners too. Point out to them, very clearly and in writing (typed warnings through letter-boxes) explaining who will be ticketed (them and their visitors, relatives etc). Make sure your notes show them examples of PPS court claims, because some people still think these can be ignored. They need to wake up and smell the coffee.

    Complain and stop it if you all possibly can.

  • Thanks for all the replies so far. All great suggestions and info. Us houses are going to get onto a solicitor. Also that's a great idea to contact the flats to tell them about the charges they will be facing along with possible penalties. If it's the flats that have asked for this action then they've really shot themselves in the foot.

    Once the PPC has got rid of any perceived fly-parkers (which won't take long), where does their ongoing income come from? The PPC will be there for the long run in order to recoup their investment in setting the parking arrangements up.

    Well the only source of income left can only derive from residents whose permit might have slipped on the dashboard, or a tyre partially touching a line - their lives will be far less stress free in future, having a vulture constantly circling (often in the small hours), looking to swoop on any small chance of a quick meal, will have everyone on edge and always looking over their shoulders.

    Warn them of the threat to the 'peaceful enjoyment' of their property. Get them to check their deeds/agreements. Tell them to come here if they want further advice or if they receive tickets.
