hi sorry to jump in on this post but not letting me create my own thread. me and my partner are in a similar situation with the property we are buying. The house has a sewage treatment plant in our garden but is shared with a neighbouring property. The title deeds are defective and there is also no rights for us to drain the effluent from the tank across the neighbouring property. our solicitor has also said nothing can be signed off for the lenders until sorted. Was a indemnity policy required for yourself in the end?0

Indemnity insurance might/will
* pay out to cover costs if problems arise in the future
* satisfy a mortgage lender and let the purchase proceed
But will it satisfy you?
If you were suddenly denied use of the tank by your neighbours, would money be enough? You might find that having to use the local pub every time you want a **** or a **** somewhat inconvenient for the duration of months while the issue was resolved.
Even if all your costs were covered, that regular walk to the bub at 3 in the morning...... especially if you have a weak bladder or prostate problem.
The lender won't care about that aspect of it as long as their investment was safe.0 -
If there's anything seriously wrong with the title to a property, it's important to get the vendor to sort it, or it becomes your problem when you come to sell.
A good solicitor should know when an indemnity policy is suitable and when it isn't; that's not a job for people here.0
