Friend used mobile now refusing to pay for calls

Here is my stupidity. I took out a mobile phone contract for a friend as she couldn't get one. It was £10 per month. I was paid by her on time every month. We then fell out. My friend did not pay me for 3 months and then sent the phone back to me. She will not pay me the £30 as she claims Tesco (provider) said she doesn't need too

Am I thinking too badly in suggesting it could be fraud or deception? Or is it just another debt?:mad:

    Guessing hte contract is finished and youve settled the amounts? If not do so as soon as possible, it will only make things worse for you.

    Tesco wont say she has to pay it because the contract is not with her.

    Not fraud or deception. You took out the contract, you agreed to pay back the contract.

    You could try going to small claims court but for £30 and the fact that i doubt you have any paperwork it would be pretty futile.

    Learn a lesson.

    Sorry i cant offer anything nicer. Although it could've been worse if they decided to rack up a huge bill if that makes you feel any better.

  • Your friend has been kind. I could have been a LOT worse! A £30 lesson is good value for you.

    Legally Tesco won't expect payment to come from her (the contract is in your name, so you owe Tesco the money whether she pays you or not.)

    However I doubt Tesco have told her anything, as most providers are very strict on only speaking to the account holder (you.)

    Morally she owes you the money of course but it doesn't seem as though she has any morals. If she thinks she can stop paying for something once she no longer wants it, she obviously hasn't learned from earlier dealings with credit in her own name.

    If there was a handset with the contract that she has returned to you then I would try to sell it to recoup some of your loss.
