To pay or not to pay indemnity insurance for a historical right of way? Help please!

    Indemnity insurance against what exactly?
    Good question! It turns out the insurance is for a joint path, not the right of way but even so, insurance against what? The only thing I can think of is that it's against the neighbour I share the path with putting up a lockable gate and keeping the key, to prevent me getting to my front door and down to the garden gate. When I put the question to my solicitor, she gave no clear answer but, having said she agreed with me not to pay, told me today my Buyer's solicitor is within their legal rights to ask for indemnity insurance as the Conveyance doesn't verbally state my right to use this path, in spite of it being clearly and indisputably marked as within my boundary line on the map attached to the Conveyance. :cool:

    Now that does make more sense.

    As for who pays, it's whoever blinks first. If you really want the house pay for the indemnity. If you are perpared to walk away and find somewhere else then stick to your guns. There's no rule about who pays.
