is regular extra pay included in "Notice Pay"

I wonder if someone could offer me advice.

I was advised i was being made redundant last week. I am currently on a 3 month notice period with my employer.

The company are paying me the 3 months notice (i work in IT - so quite normal not to work it). The payout is my base salary times 3 months (plus statuary).

For the the last 12 years - i have done on call every month without fail which is paid on top as an extra each month.

Should that be included in my "notice payout"? Should i get that 3 "on calls" as well do you think or should it be based on basic salary?

    Are you required to do the on call? Or is it a choice?
  • There was no choice as such. We are a 24/7 business with 1 person on call to cover out of hours. We were on a rota of 4 people doing it once every 4 weeks. We were expected to do it. If you had refused - not sure what would have happened.

    "As such" isn't really an answer! But if it is regular, then I would say that it is included for the purposes of redundancy pay - if the employer didn't include it I would want an explanation why not.
  • My previous company redundancy payment was based on Basic pay, when we raised the on call support payments (we had a team of 4 who rotated on 24*7) the company agreed to pay the full on call for the remainder of the year (9 months) as part of our settlement agreement, so we agreed on that. Most redundancy payments are based on Basic Pay, so without car allowances/bonus etc.

    Sorry but that isn't accurate. Car allowances and bonuses are not part of basic pay - but shift allowances, for example, are. There are separate rules about some allowances that mean they are part of basic pay.
