I want to be crystal clear - I might not have chosen the same path in life as you, be that kids, someone smoking, someone gambling, etc etc etc - that does NOT ever mean you are not a human being with rights just like me in my eyes

Just because you ended up in a situation because of a different life choice to me doesn't make any differenceI got in debt before my DD was born - we all end up here for different reasons. If we all had issues with the HOW and WHY then we'd never end up helping anyone!

I've spent this evening having a long hard look at it all, it's going to take me 11 years to clear the debt at £150 a month- that's insane considering most of it is from my stb ex husband and I was stupid enough to let it happen.
I can Condemn my kids to 11 years of this crap!
I will call the money advice tomorrow and go ahead with the insolvency.
I need to prioritise finding a home and looking for a new job before I can even begin to look at paying debts off so I think insolvency is our only option.
Thanks so much sour crates and fat belly for your advice and kind words.
And everyone else for that matter for being so kind on this thread.

The council have effectively taken the bankruptcy decision out of your hands by involving bailiffs for what isn't even a significant sum in comparison to what it would have been had you not been making an effort to pay before they decided they wanted the lot; and considering how much the enforcement/bailiff fees are. The council should have known (if sense prevailed) that you were making an effort and they deserve to have the fees fall on them (which they will with BR.) They could declare you bankrupt anyway as you can't pay, so might as well do it yourself. Sooner it starts, the sooner you'll be discharged, and the sooner it'll come off your credit report (after 6 years.)
In most cases I do believe that the debtor should pay, but it's important in this case to note that not all of the debts are Kim's fault (one or both exes are involved in them as well as failing to provide for their child/children.)
As far as I'm aware you have to start paying council tax again in the April following BR, so you should now focus on financing the move and council tax for the new place when it becomes payable, with any money that you can spare.
Have you claimed all the council tax reduction that you can? There's a 25% reduction for being the only adult in the household, plus a reduction scheme for people with low assets and income.0 -

You're going to have to find £680 for the bankruptcy - the fee went up a bit in July and there's no help for those on benefits,, as there used to be.
On the flip side, the Official Receiver now doesn't seem to mind you using a debit or credit card that will then go into bankruptcy.0 -
I was just reading this with interest. I found a good facebook page called 'council tax my a*se' it makes compelling reading. I cant put the rude word but just think of jim royale and his catch-phrase 'my *rse'....0

Money advice Plymouth have just got back to me regarding everything and apologised for not answering the phone but they have had an influx of people needing help this week due to bailif visits from the same one as me- seems they have been using their aggressive tactics on many people over the last week.
Apparently he threatened to use bolt cutters on someone's front door to gain entry and has tried to gain entry to other people's houses by trying the front door etc.
Says it all really.

It seems all the rule changes of a couple of years have achieved is to increase effective bailiff fees by a factor of around 7 (from £42.50 to £310) - the intimidatory behaviour continues, with the tacit approval of the local councils.
The guy should be reported, first to his employer, then the council, possibly through your local councillor and ultimately you could alert the court that awarded his licence, assuming he is certificated, which he should be.

If you know of serious conduct issues which would mean that an existing enforcement agent, or an applicant for a certificate, is not a "fit and proper" person, you can use this register to find out which court you should alert to these issues. If you are concerned about a person applying for a new certificate or a renewed certificate, the register also contains the date of the hearing where the judge will consider the application. By addressing your concerns to the court before this date, the judge will be able to consider these as part of the application0 -
