Kim - I thought you were going for a DRO or bankruptcy with the help of your local Money Advice service
  • Kim is vulnerable if you read her diary you will see why.

This is not having a go at Kim - I have been following her diary and know the circumstances but council tax has to be paid. If not a lot of other vulnerable people will not have their needs dealt with.

The bailiffs will not be able to force their way in and usually, pass the debt back to the council if they cannot collect.

If you can get the council to take the debt back and try to reach an agreement it will be a lot better as arrears can affect your right to pay in instalments in the future.

Parts of the above link will seem quite daunting but when it talks about court, it does explain that the court will take account of circumstances and ability to pay. If you cant pay what the council wants they will not try and force you to.

The link below also explains what the bailiff can and cannot do.

    A couple of more links

    https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/353396/taking-control-of-goods-national-standards.pdf

para 70-78 deal with vulnerable situations

    https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/210478/Guidance_on_enforcement_of_CT_arrears.pdf

para 4.8-10 deal with people in vulnerable situations.

In this case Kim just to get on with insolvency, but reporting the misbehaving bailiff (see CIS's post) is also important.

I was going to but then lots of people on here and in real life said it was shirking my responsibility to pay so I decided to set up payment plans.
I'm trying to do the right thing but it seems so hard when I keep getting knocked when I'm already down.
I think Bankruptcy is the better option TBH as I'm scrimping to pay £150 a month off my debts, and TBH if it wasn't for the foodbank we wouldn't have eaten recently.
I just don't want people to think I took the easy way out, I just want to do whats best but it seems its not good enough in the eyes of these people as every creditor seems to think that their debt is more important than all the others.
I am going to go with my original plan and go bankrupt as this payment plan just isn't working.
Just a single mum, working full time, bit of a nutcase, but mostly sensible, wanting to be Mortgage free by 2035 or less!

I agree with sourcrates. You have had a ton of stuff thrown at you recently what with absent father to your little boy, landlady throwing you out and now job loss. Do what is best for you and children. On a reduced income £150 is a lot to find. You need to save that for your next home when you get one. Bankruptcy though is not the easy way out so please do read up on the implications before going that way. Council tax always comes above unsecured debt though.

  • They will make 3 visits.
If they are ignored each time and the property is secure they can not enter unless you fall for the tricks and threats and let them in.
Think Vampire, they have to be invited in.

After 3 visits, the council will then deal with you directly, you do not have to pay the Bailiff charges as you have no contract until you make one with the bailiff.

Ignore threats about locksmiths, vans and police, lock up do not contact them and they will give up after the third attempt and you can deal with the council, make it clear you are only paying the amount owed in council tax.
I do Contracts, all day every day.

Amen, sourcrates, and thank you, fatbelly, too and everyone else on here for behaving like decent human beings and not the worst element Kim's other threads seem to attract.

Can't say it any better, Kim, who cares what anyone else thinks? The hell with the lot of 'em, it is your survival and you and your family's lives that matter; anyone who wants to troll can just troll off. It is admirable that you have tried to make things work without going down the debt management/bankruptcy route but sometimes, the bravest, smartest thing a person can do is to ask for help. No-one can say you just threw in the towel the moment things got tough but it is time to grab that lifeline and let someone help you get to the shore, sho' nuff.

  • Kim, if you lived your life according to how others think you should, you'd have no life at all.
I read your whole diary last night and I was so moved by it all. I had never come across it before as I don't generally read the diaries, it somehow seems like peeking into people's minds. I have been thinking about you and your children ever since.

I cannot remember if you have a debt charity helping you, but I hope you do and that a plan can be made for the best outcome for you and those sweet children.
Your intelligence shines through your diary and your determination in life. I couldn't give a toss as to how you got your debts, you and those 8 children deserve some peace in your life and if going bankrupt or some other debt solution can make this happen then let it. Bearing the considerable weight of responsibility of 8 lives plus your own, it is necessary for you to be able to carry on and do that and not be so pressured that you can nolonger cope.
So, a mental V's up to the trolling brigade, they don't live your life or have to watch your children cope with bailiffs.

I have been priviledged to have a peek into your life via your diary and one observation I can make is that your children are very lucky in 2 ways, your love for them and the amount of intellectual stimulus you give them.
    Rock on , Kim.
  • " I just don't want people to think I took the easy way out,"
    Kim's post from above.

THE EASY WAY OUT...WITH 8 CHILDREN...... if anybody ever said that you were an easy option merchant, I would die laughing. It is amazing how we listen more in life to the crap some people tell us, rather than the good.

    I will shut up now!
