    I have never seen anything about the small claims court querying the ISPA nor have I ever seen the ISPA feature in any defence either , plus its got nothing to do with LINK PARKING , nor the IPC , nor Gladstones

    prankster is saying that the BPA wont have a scrutiny panel, same as the IPC dont have one anyway , so they have levelled the playing field to a sea of mud , which the courts dont care about

  • In a few weeks time I will be seeing Gladstones' man or woman in court.

    But to rub salt into the wound the other day Link Parking stuck a parking charge ticket onto the windscreen of my son's car in his own space in his own car park.

    His permit wasn't showing, so "geeza hundred quid" yelped Link, like a dog with a bone.

    Even after this latest escapade into rubbishing the rights of the residents, the property management board are not being helpful at all to the residents in either of these PCNs. Probably because they hate to admit they got it wrong by employing Link. Or possibly for some other reason. Who knows!?

    It was suggested to me that a witness summons could be sent to the agent who instigated the use of Link. Has anyone else ever done this? I am sure he would decline the offer[!]

    His other option is to get around to answering some of our many as yet unanswered questions on my case. I realise that calling someone (who is not keen) as a witness incurs costs. But I'd like to see which side the management agent's bread is buttered on.

    Any thoughts on this tack?

    Form N20, I believe it will cost £50 fee.

    The Summons should go to the Secretary of the Management Company and the resident can even give the Witness a lift to and from the court to save costs. Ha!

    You might want to ask the BMPA as they have another similar case in hand that I am aware of. Unless that's your case?

    Even to suggest it will put the wind up 'em, but I'm tempted, I really am. His day's costs for missing work would be silly numbers though.

    I think it is worth putting the wind up them by writing to say that's what he will do unless they cancel. He could enclose a 'draft N20' (borrowing the tactics of the PPCs!).

  • Btw, Coupon-mad, it is now more than 14 days since I emailed the lawyers the letter, as discussed above. Of course I have heard nothing. As you say I will use that non-communication in my WS.
    Yes - and that reminds me - give them a short time to confirm the claim has been dropped (14 days).

    Then if they ignore it, just crack on with your WS and evidence anyway, including that letter in your WS facts of what happened/how you have tried to resolve the dispute.

    The BMPA are very useful. They sound like you at times. Sharp, detailed and straight to the point.
    I would say we are kindred spirits but the person helping you is more legally minded than me. The BMPA is a very useful resource indeed and we are lucky to have the people behind it. I just have an eye for detail, a good memory and I'm good at writing complaints and similar stuff!

    If it was my son...yes I would, because I prefer to be proactive and rattle cages to resolve a dispute or scam like this, rather than wait and see.

    e.g., a small example, my DD was once not paid for a shift she did somewhere local - I think they thought they could rip her off because she was a young pre-Uni student looking to make some money from a Summer job. Rather than wait and see, the following week, the narky Supervisor who had lied that it was just a 'trial shift' (not true, DD had already done one and passed with flying colours) got what amounted to a LBCCC delivered by hand, with a threat to contact the people higher up the 'chain' in the company. The money appeared in my DD's bank account within 48 hours. The place is under new management now but I can't claim to have caused that (but had we waited, my DD would never have got her money). I think, do things early.
