Armtrac sennen advice please

Hi. I have read the thread but have a question please. We paid for a day ticket and put it on the dashboard. After we left the car park we notice a fine stuck right under the windscreen wiper - we only saw it when using the wipers! The notice says the ticket wasn't clearly displayed but it was! They state they are members of IPC. should we appeal right away - we have the parking ticket we purchased or should we wait for the 24 days? Or do nothing. Thanks for any help you can offer - we are both worried, cross and frustrated at the same time. :(

I think with IPC members you appeal as keeper around day 19 , using the IPC template

then ignore if they dont cancel

keep hold of the ticket that was bought , in case they try court

    dont bother with the IAS

do not reveal who was driving

    that is my opinion anyway

Or, wait for the first letter to arrive next month, then send the challenge because it looks less like the 'driver' appealing. Which PPC?

its the M.C. at armtrac (arm twistinguponesback)

KBT Cornwall Ltd (Trading as Armtrac Security Services) - another A.S.S. ;)

or Keep Bilking Tourists Cornwall Ltd !!

and yes , the OP could wait for the NTK and appeal, as long as the OP realises that this will be rejected (which the vast majority of appeals are , because there is no profit in upholding appeals , even valid ones)

the GREED FACTOR means they will try to bully and coerce the "victims" into paying

cornwall will become a tourist desert the way the private parking companies treat the occasional tourists , they treat them like pheasants on the glorious twelfth

its like a double dip pickpocket

you pay to park, and they still want to sting you with pcn,s for up to £100 payable within 6 years , just because they can get away with it

they should be content in knowing that some honest people pay and accept the lowly parking fee in good faith , but the greed factor kills the thought stone dead

It is frustrating because nothing you do will cancel this, but it is best to challenge it once, as that will look more reasonable if you have to fight these ex-clampers in court. Defendable certainly. Nasty, yes. Complain to your MP.

  • The company is KBT Cornwall t/a armtrac. It was on the bottom car park in Sennen. Is it likely they will take us to Court? Thanks for help

Yes they might do. Search the forum (this board) for 'Armtrac' if you haven't already.

We are NOT telling you to pay. If you pay them for an 'easy life', you'll have just supported the scam...we won't want to hear that. Read all the other threads from people ignoring this trash after one challenge.

DO NOT try the IAS appeal stage - but then you will learn this from the other threads exactly like yours.

There's no real 'previous', but lots of PPCs are chancing their arm since the Beavis case.

    http://www.bmpa.eu/companydata/KBT_Cornwall.html

But let's get the hysteria out of this - it's not the police/Crown Prosecution Service taking you to court. No stigma, no sentence, no jail time. It's just a small company who've sent you a speculative invoice, which you dispute, and a judge, sitting with you and the PPC around a table (now wigs, no gowns) trying to sort it out between you.

And in the worst case scenario, should the judge find in the PPC's favour, no CCJ, no credit endorsement, no nothing, provided you pay the costs within the timescale required by the judge.

But you have just as much chance of winning - with costs awarded against the PPC in your favour.

Just as you're doing, the PPC will also weighing up the county court lottery, and will likely be just as concerned as you are about losing. See what transpires. We're here to help should it get to the county court.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • When I got a ticket from them at that car park, they were very good on taking photographic evidence. Did they do so on this occasion? Is there anything that shows that the ticket was not clearly displayed?
  • Hi. We haven't made contact asking for this yet - as we didn't actually see the ticket until we were miles away, as it was craftily tucked under the wipers which are lower than the bonnet - we didn't get a photo of how it was - but definitely it was on the dashboard - I think they will say it was upside down so the print wasn't easy to read - so annoying.

Annoying... yes and they do this all the time. So what? How does it matter what their 'reason' is?

Not so annoying that anyone here PAYS parking firms, just because they warble on about a 'fluttering ticket'. Who cares what they say. A rejection letter isn't time to pay. You need to be ready to sit tight and ignore some silly letters for months and you could do nothing, and just respond if they try a small claim later on. We will assist, these are defendable and nothing affects your credit rating as long as you do not ignore court papers (or miss it if you move house within 6 years).
