    That's what I'm wary of. It doesn't seem my most relevant point. And it also references Beavis, which some forumites seem wary of quoting...

    It's the BPA template in blue. You have been told this twice. It's the only one in blue, and is preceded by "Template for BPA members ..." I'm sorry, but if we tell someone which one to use then have to reply several times to the question "is it this one?" it gets a bit tiring especially when you consider the number of posts the regulars here respond to each day.

    Nobody is going to spoon feed you. We will guide you but it's up to you to do the reading and leg work.

    Forget about telling them what happened or being as honest as possible. You are dealing with scammers, so you appeal using points of law, not what happened on the day.

    Isn't that the place that featured in a TV series? That'll be why some people are still willing to be mugged - they think it must be a "special" place since it was on TV. ;)

    It seems more specific to a case, being as we have the same grounds to appeal as this person did. Just feels like a better idea - to me - to quote genuinely extenuating circumstances, rather than just quoting the Beavis case at them.


    But you guys are the experts and if you think I shouldn't mention the breastfeeding circumstances, then I won't...

    this is PE and I doubt they will back off, so I would not change the advice about using the blue text appeal in the newbies thread

    I do not think that the EA2010 applies here (but am happy to be proved wrong)

    its your choice though , not ours

    but PE issue tens of thousands of court claims per annum , so bear that in mind

    Never ever lie to a parking company, or anyone else connected, the people who run these companies are scum and will grab at anything you give them.

    As for the Adelphi you should also complain to them, tell them (dont ask -tell) to cancel and also state that you are shocked that they think a company with a reputation as poor as parking eye, that belongs to an un regulated and out of control industry is suitable for an establishment such as the Adelphi.
    Also state that the British Parking Association limited is no more than a private members trade association and not a regulatory authority.

    You should also state that the Adelphi are jointly and severally liable for the actions of their agents, in this case parking eye, and you do not wish to waste your time in dealing with such an awful company (parking eye ) therefore you expect the Adelphi to cancel this charge with immediate effect and issue a full apology together with re-assurances that this will never occur again.

    Also throw in something like this....
    As a goodwill gesture I am prepared to forgo my costs upto this point on the condition that the Adelphi does the right thing and cancel the parking charge. Should the Adelphi chose to allow their agents to continue to pursue this matter then the Adelphi may be liable for my costs of upto £19 per hour pr part thereof, as well as any other costs/expenses. a full time sheet will be kept.
