Got the second letter from DRP today

"As you haven't contacted us to tell us that you're not liable for the charge, we've taken this to mean that you agree you're liable for it"

Now they have given me until 27/9/16 to pay or they "will pass my file to our client with a recommendation that they take court aciton against you"

The wording here is much different from the original letter... this now seems like a scam to me.

"this is your last chance for an easier, more affordable way to pay"
    not very legal sounding.

I must admit, I was very worried at the first letter, but this one is just a bit more like the Nigerian type scams.

I will keep you updated with the outcome...

    so far:
No contact from the client (NCP) before or after.
    2 letters from DRP.

You are sussing the letter chain nicely now. Quite rubbishy, aren't they?!

I knew there was something similar to their letters, could not put my finger on it but now I know.
They must be the Nigerian scammers ???

Got the third letter from DRP today.. Although in last letter they said I had until 29th to pay, today is the 29th and I have a third letter...

    I honestly love this lettter.

"we recommend to our client that they appoint their solicitor to start court action against you.

When taking any court action, our client must demonstrate to the court that they have done as much as possible to settle the matter out of court. This is known as 'pre-action protocol'. As part of this, our client has told us that, if you want to settle this matter once and for all, they're willing to accept £119.20 instead of the full amount of £149.00."

    Aren't they considerate souls?!

"This is our client's final offer to settle the matter before considering taking court action"
You have instructed to the client to take action... why am I getting an offer of a slightly reduced rate of an astronomical amount in the same letter?

I now have until 11/10/2016 to pay the reduced amount.

I will see how this pans out and keep the forum informed, this may help others in my situation.

That's normally the last you'll see of it. They bluffed, you called it, they shut up.

£119.20 sounds very specific, doesn't it?

It's never been back to their client, and that's got nothing to do with pre-court protocol, they are just trying to think you're getting a good deal.

The Practice Direction on Pre-action Protocols and Conduct also requires that they supply to you all of the documents they intend to rely on in court. I'd just bet a pound to a pinch that those letters contained nothing more than fresh air and what's more I suspect that DRP wouldn't recognise the PD if it was to jump up and slap them in the face. Much like other debt collectors they spout unadulterated BS in the hope that it sounds impressive enough to frighten some people into paying up.

As I have said many times before the HO87-ettes (all now well into adulthood) found that shredded debt-collector letters made excellent hamster bedding.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
