CCJ - solicitors cease to exist

    no one can object to a set aside , and I should imagine you would get your fee returned


    you may very well find that this company was acting illegally , there is a good chance that they were dissolved , you got a default judgment against you because you did not fight , or the paperwork went to an old address?


    the ccj would have come into force approx. 28b days after the cc case , what month was the CCJ issued , as they were dissolved back in feb 2012?

    Even if you now settled the debt. Doesn't look great from a mortgage lenders perspective. Speak to some mortgage brokers to ascertain the extent of the damage. Different lenders have different criteria.

    if the company (solisitors) started the court action , and sent paperwork to an old address (etc) they would - even when ceased trading gain a default CCJ , its upto the OP to state the date of the CCJ , and also if they received the court papers and did not act.


    first step would be to contact the court again and get the address that the claim was sent to

    If that is the address provided by the person owing money then they did nothing wrong, it's up to person owing money to keep them posted and up to date, not the other way around.

    And as it is there doesn't seem any grounds for a set aside, as even OP admits as he owes the money. So even if they were to send it to the wrong address, or make other clerical error, judge would need to see a reason that would make him not owe the money, and that just doesn't seem to be the case so CCJ is valid and will stay. Unlike in the movies a small technicality doesn't make a ruling invalid.

    Best OP can do is pay it, as he owes the money, and either wait extra two years with buying house or find a good broker.
