Parking Court Settlement

Ok... So a long story short. I had a run in with this company who turned down when i paid and displayed and they gave me a ticket.

After reading loads of forums people told me to just ignore them and on a night when I used to work at a nightclub I used to park there and forever got tickets. I was literally the only car there.

Now they have sent county court bulk centre letters and I have been informed off a few people they will be hard to beat in court so we are speaking about a tomlin order been set up.

I dont really have a leg to stand on but Ive heard you can offer pretty low on it as there charging pretty much £100 per ticket.

Here is the email they have sent with an offer. What would you offer them as a counter?

All the cars have long gone hence me showing.

I am emailing further to your email below in regards to all Parking Charge Notices (PCNs) relating to the address XX Having looked into the matter, please be advised that there are a total of 40 PCNs, registered to the address mentioned above issued to the above mentioned Vehicle Registrations.

In response to your representations regarding your appeal back in 2012, please find attached copies of all correspondence in relation to the matter. As you will see from the attached correspondence, all pieces of your correspondence were responded to and sent to the above mentioned address. I would like to confirm that the attached responses clearly explained our decision and addressed the issues you had raised in your initial appeal. As such, a final decision was been made and the charge was pursued accordingly.

With that said, please be advised without prejudice, in an effort to settle this matter promptly and in an amicable manner, and also in an effort to reduce further costs being incurred, we are willing to accept payment of £3,800 as full and final settlement for all 40 PCNs listed below, including the PCNs not included in the court claims as well as all interest and court fees. This offer is only valid for 14 days from the date of this email.

FP60VJD - 1 PCN issued 06/04/2012

LR60KVG - 1 PCN issued 02/01/2013

H6APM - 4 PCNs issued from 31/01/2015 to 04/05/2015

DD08OND - 5 PCNs issued from 19/10/2015 to 27/02/2016

DB04OND - 11 PCNs issued 21/12/2013 to 06/12/2014

YC13RMO - 18 PCNs issued from 31/10/2013 to 27/10/2015

    First things first, remove all those VRNs from this open forum post which anyone can see.

    Secondly, why did you carry on parking where you were clearly unwelcome? No-one here condones that - in fact (sorry to say) it is people like you who give credence to the existence of private parking firms. There are not many of you about, most people here are unfairly ticketed but you are admitting to taking the mick, it seems to me?

    Thirdly, which parking firm?

    Fourthly, who the heck have you been taking your awful advice from so far?

    With the potential size of the bill, I think the next advice taken should be from a solicitor.

    Perhaps they are looking for bogus addresses/appeals where people have used a maildrop to hide the identity of the driver.

    If this is the case, legal representation is more than worth the outlay.

    my research indicates it was VCS so maybe BW LEGAL are involved ?

    due to the volume of tickets I would agree that you should seek professional help

    I think the OP is a chancer that has extracted the "whatnot" of the owner of the land

    With VCS their signs usually forbid you to park. In that case this would be a case of trespass, and not a breach of contract. I strongly suggest you find a decent solicitor to advise you on the strength of that particular argument. You should refer them to this case reported by the BMPA

    Yes. And how has the claimant evidenced who the driver was on all 40 occasions?

    Who suggested the Tomlin Order and why did that person not point out the possible defence issues that we are pointing out?

    We reckon you have the possibility of defending on signage and no keeper liability, seeing as it is well-known and easy to spot, that VCS do not use POFA wording so can't hold anyone liable unless they were evidenced to be the driver every time...how have they evidenced that? They can't make a presumption and nor is there any obligation on you to assist them to identify the various driver(s) - as was confirmed by Henry Greenslade, (barrister, parking law expert and erstwhile POPLA/PATAS Lead Adjudicator).

    Would the link below be the location of where the tickets were received? This is just behind the Corn Exchange. There is a small VCS sign on the wall to the left of the very large sign that says 'Welcome to Crown Street Car Park'. It also looks like the VCS operate in the car park too.
