Excel Parking, BW Legal and now what looks like court papers

    Unfortunately, this is one of the downsides of challenging RoA.

    I had a case where we successfully challenged the claimant's advocate last month, and the Judge read through the submissions. She agreed that they didn't have RoA as per the articles and cases, and said it wasn't her place to go against the Law Society or the Bar Council.

    But, she wouldn't go as far as dismissing the claim, she said she had discretion over the application of CPR 27.9 (non attendance of a party), and adjourned the case, awarding wasted costs to the defendant. Round two is back in court next week.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
  • Judicial discretion. Still, it's a win of sorts since they'll either have to pay more for representation at round 2 or risk a judge happier to strike out...

    I'm new to this sight come for a little rant. Well the other day I received an excel parking charge letter to my ex partners house. I opened it and it said that I had been in the Iceland car park a private car park that Iceland work along side with. I was 32 miniutes this was on the 21st of may. So the first thing I did was go online to look at this company no matter how many times I tried to input my details nothing came up on the portal. So I rang Melton Mowbray store and asked to speak to a manager. I spoke to a guy called PETE initially he was helpful he said to email the company. So I started writing an email to excel and it was undelivered so I rang Iceland again asking for PETE told him I could be doing without all this. I said to him I did my shopping in your store I purchased a ticket was clearly able to see on my dashboard and that I had been on my online banking and even told him I have proof of transaction he said he didn't dispute the fact. So then he said he had an email for them which was not on this letter. So I proceeded to email them got an automated response. Throughout doing all this it stated that unless an appeal is done through the portal that this could not be disputed via email. Eventually I got onto the portal and appealed it. Not stopping at that I had visited the police station and they said visit Iceland and voice your concerns. So I went in and asked a member of staff for PETE told her I had spoken to him on the phone already twice. He walked out this office and he was wanting to talk about this in open view of all the customers. I said I'm sorry Pete but I am not prepared to talk about this unless it is in private!!! He then took me partially into this room next to the office he had walked out of. An I started showing him my transaction and said is this how you treat your customers. I don't shop at Iceland a lot but even still I was still a customer. He was stool ther shakey not knowing what to say. I said you can clearly see that I have been in you're store and unless this matter is closed I shall not be visiting your store, he said he will try to email excel and I said and how do I know you will do that. He said well u will need to take my word. And then I said well if I have not heard within 24 hours I will be going to the local papers. Because I said you work alongside this company you need to sort it. He was absolutely useless how he became a manager god only knows. Anyhow still not content at this I decided to google Iceland head office and I received an apology the following day and ther have passed my details into 1 of ther departments. To be cancelled but until I have that in writing god only knows. They also offered me a good will guesture

    Hi, could you please paragraph your post, many will not read a wall of text

    Managers of these stores are just glorified shelf stackers and don't realise that lack of customers means his job is on the line

    It's not all over for you until you receive confirmation from Excel

    Yes, we all know that Excel are pond life and nowadays, the courts are thinking the same
