Ex opened my mail & tried to bank cheque.. What can I do?

So my ex husband to be lives in the marital home and has opened a PPI reclaim cheque that was sent to me in just my name and tried to bank it in out joint account that is OD and suspended until finances are sorted. So he has done this despite me having 3 children and a huge rent with a much lower income while he's there in the marital home with a tiny mortgage and no overheads like cars to worry about!!

I'm fuming what can I do? The bank are sending me a copy of the cheque and the paying in slip at HSBC can I follow this up anyway or get some justice??

    Did he actually managed to pay the cheque in?

    The PPI was investigated about 2 years ago and they said they had no records, since then they've been told to investigate and the cheque was out of the blue, I had a redirection on for 6 months and everything is changed.

    He did bank it but First Direct called as it was unusual activity and won't be banking it.

    I just know this is so morally wrong on his part and needs to be taken further!

    I'm surprised HSBC refused to accept a cheque paid into an account with your name on it that is overdrawn. I would have thought they would have taken the money to clear the overdraft.

    You need to pay for redirection of your mail

    The funds have been sent via Bacs so luckily he didn't get a penny but the fact he has tried to cash it and could have succeeded if FD or Barclaycard weren't as efficient.

    It was First Direct and the account is in dispute so luckily they also care about their customers as well as their debts!

    Like I said the redirection was on and everything vital is changed although this cheque was unexpected and totally out of the blue. I don't expect anymore but my point is he shouldn't get away with this surely? Although there probably isn't much I can do about it.

    I thought obtaining funds deceptively, opening my mail and clearly trying to bank it at my detriment.

    As he tried to pay it into an account that is jointly yours then I'm not sure he's done anything illegal. It would be better if you didn't have any joint accounts with him any more but I know that might be easier said than done.

    Opening post that was addressed to his address isn't illegal either, unless you can show he was doing it was intention to cause you harm or loss. You could have done this if he took the money but he paid it into an account that is also yours. The main thing is the money is coming to you now.

    He tried to bank it into your bank account. Not sure you can report him to the police for that! He may have well have had plans to withdraw the money but you can never prove that.

    You can quite easily argue that you misread the post and though the Mrs was Mr and then when you realised your mistake you went to pay it into your wife's bank account.

    Obviously this isn't what happened but it's going to be very unlikely the above could be disproved.

    Phoning the police for this will be an absolute waste of everyone's time.
