Tech prob on previous flight, can I claim 4 delay??

Hi All,

Apologies if I've missed this on MSE somewhere but can only find reference to 'Bad Weather' affecting previous flights not technical issues, anyway:

[FONT=&quot]Back in Nov 2012 my in-laws outbound flight from Heathrow (MH003/06) arrived 1482mins late at Perth Intl. Airport because Malaysian Airlines claim the inbound flight MH002 (operating the MH003) experienced a 'manufacturing' technical defect with the braking system. Although personally I noticed at time of booking they had very low passenger uptake and tried to bump all passengers onto one flight![/FONT]

[FONT=&quot]Whilst I shall be writing to the Civil Aviation Authority to confirm this, does the fact that the fault actually happened on the previous flight to my in-laws mean I can claim for them anyway, and if so what point of law do I quote please?

    Nov 2002 = more than six years ago so out of time to start a court claim. (five year limit in Scotland). This date is also prior to the Eu261/2004 regulations coming into existence.

    Save yourself the trouble and not bother contacting anybody.
    The above is just my opinon - which counts for nowt! You must make up your own mind.

    How long was the delay on MH002 to KUL, forgetting about the next leg to PER?
  • Departure delay was 10+ hours in Heathrow.
  • Tech problems on a previous flight are not (generally speaking) 'extraordinary' and compensation is due. The 'wriggle' deployed by the airline here is that it was a 'manufacturing defect' i.e. a problem with all aircraft of that type, which can be a getout. However, such a manufacturing defect will have been notified to the manufacturer, resulted in a recall etc etc for which they will have all the paperwork - I think this unlikely. So read Vauban's guide, check on Botts or EUClaim site and then decide whether to diy or use nwnf.
