Hi I'm a newbie to this forum and I received a parking charge for non display of a blue badge in a disabled bay on private land. The ticket for the charge was written out at 16:53 and my vehicle was observed at 16:58 and now it's got as far as the threatening debt recovery letter from the solicitor. Any help or advice would be gratefully appreciated thanks

What is the name of the parking company?
Did you appeal the invoice?
When did this happen?
Who is the regstered keeper?
In which country within the UK did the alleged event occur.
Have you complained robustly to the landowner.
It would be useful for us to see redacted copies of your paperwork as well.
Keep the driver's details to yourself.
I'm assuming as a blue badge holder that you know the government scheme does not apply on private land. Making someone who is disabled and has protected characteristics do something an able bodied person is not required to do is a breach of the Equality Act 2010.

Company is UK CPS Ltd and its miah solicitors Sorry about the delay but having to deal with the fact that my wife is fighting cancer. Thank you for your help0

its either pay ( not recommended) or ignore (for 6 years)
ie:- sink or swim , there are no other options
sometimes you just have to accept what you see and dont look for options that dont exist
UKCPS (or the landowner) have 6 years (in england and wales) to take out an MCOL (court case) and to try to prove their case, whereas you (or the driver) have the right to defend yourself in court
this has always been the case for an unpaid invoice since 1973 !!
if you do have to do something, you send a "debt is denied so FRO" letter , like those GAN produces over on pepipoo , with free cert of posting at the P.O. counter, ie:- letter tennis at the pre-court stage
this wont stop the deluge, but will be a part of the paper trail of evidence if it goes to court
we always tell people to complain to the landowner and get it cancelled, yet the vast majority overlook that possibility even though it is ALWAYS the best option

So very sorry to hear what you are both going through. Was the car parked in the disabled bay because she (or another person with a long-term condition affecting daily living) was in the car?
Your wife would meet the definition of disability in the Equality Act 2010. She has 'protected characteristics' under that Act, without a doubt. Relevant if she was in the car, or another person with a similar long-term medical condition.
A service provider (like a parking firm in a customer-facing car park) has a legal obligation (statutory duty in law) to make 'reasonable adjustments' and not impose blanket policies on people which may affect disabled people adversely (Blue badge or not).
If the above is the case, I would write as the keeper, deny liability (IMPORTANT - without saying who was driving) and provide proof - if your wife is OK about this - of the medical condition being treated and cite the protection in the Equality Act 2010.
There is no excuse that the service provider did not 'know' about anyone's condition up front. They have a legal duty to the population at large to avoid 'indirect discrimination'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
