Car insurance voided from inception-Help and advice needed

    What could have happened is that when you moved from Octagon to SureThing, you may have kept your no claims as no claim was made. (The this party would have 3 years to bring a claim).

    SureThing only know you had 5 years, as Octagon told them you had 5 years. Meanwhile the other party has put in a claim. Same thing could have then happened.

    So then when Direct Line come along, you're telling them you have 8 years no claims, and no claims made, but they find there was 2. Had they known about the 2 fault claims when you took out the policy they wouldn't have given you a policy or they would quote very high.

    It seems when the third parties have claimed off your policies, Octagon haven't informed you - have you spoken to them to clarify that claim as you'll need those details, as well as for the 2nd incident you had.

    That is the point - you completed these fundamentally different profiles, and agreed each time you submitted them that they were true. (Which they couldn't all be!)

    So that is justification to void my policy even though I have the paperwork from previous insurers which shows increasing NCB, with no mention of these claims?

    I don't know whether your "penalty" is justified or not.

    Just pointing out your transgressions which they have clearly taken the dimmest possible view of

    You should take this all the way to try and get them to reinstate your policy/remove the blight of a voided policy as you have nothing to lose by fighting it and a great deal to gain if you succeed.

    Your first posts says you were given incorrect information by your previous insurers. Did you ask if claims had been made?

    It seems you tried to take advantage of the situation and messed up.

    How are DL supposed to know you weren't aware of claims being made? You caused two accidents - most people would expect claims to have been made. You entered claims details on the sites which strongly suggests you were aware. You just chose to proceed with the cheaper option.

    No I did not ask if claims had been made, in hindsight this is what I should of done.

    DL would not know I was not aware of claims being made. But maybe if they had seen the paperwork I had available from previous insurers they may understand how I came to this conclusion.

    Yes I can see how it looks regarding the other sites but I truly did not know about claims being paid out.

    I had a letter in the post from DL today, it states.

    (We confirm that having reviewed all of the information available and having liaised with our underwriters, we have assessed that you have recklessly provided us with information relevant to us that you did not care or were not aware was untrue or misleading. Based on this we have no alternative but to instigate the formal termination of any cover which might be purported to have existed under this policy.

    We have undertaken enquiries which have given us reason to believe that false or inaccurate information has been provided to us in relation to:

    -Your history of motor claims (Whether fault or otherwise)

    Had we known that the above information was false or inaccurate we may not have provided you with this insurance policy based on its current terms.)

    I do think this is unfair and I am prepared to fight this. I guess the next thing I need to do is write a written complaint to DL with my supporting paperwork included.

    Yes.

    Follow their complaints procedure which will be set out in the policy docs.

    If they ignore you for 8 weeks or you are unhappy their reply you can then escalate to the Fos for their adjudication at no cost to you.

    Assuming you have arranged cover you do need to inform your new insurer about the cancellation now.
  • You can complain to direct line and then the Financial Ombudsman Service if you remain unhappy. I should manage your expectations though, while II think this is more like innocent non-disclosure rather than deliberate, the outcome may not be vastly different.

    direct line can prove you searched for with and without claims (as an FYI for those speculating, it's not the price comparison site that provides the data, it's captured and shared on a system that all insurers have access to for precisely that reason - some people set out to deliberately defraud them). Even though we accept your account of what happened, and your ncd supports that version, it doesn't look too favourable. If the ombudsman service accepted your story, it would look at the non disclosure as inadvertent or innocent. The remedy is then to see if DL would've offered cover had it known that the two accidents you declared resulted in claims. If the answer is yes, DL would be asked to quote you the premium - and it would be significantly higher than the price you've initially paid. On the plus side, it would normally also ask DL to remove any negative markers on insurance databases, because deliberate frauds are recorded against you and you may find it hard to find insurance for a reasonable price now, if at all.
