Have you received a 10-digit POPLA code from PE? You have 28 days to submit an appeal.
Post #3 of the newbies FAQ sticky starts you on the road to POPLA. You also need to read up on recent posts in the sticky 'POPLA Decisions'. Then do some forum searches on 'ParkingEye POPLA' as your search term which should bring up numerous examples from which to crib. Copy and paste relevant parts (proof read to ensure they reflect your situation) then post up your draft for critique. Don't use any parts of an appeal much older than around April 2016.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I just don't get the fascination with Aldi, went in one once, it was like a scruffy untidy 80's style shop of an Arthur Daly come in from the cold, hated it never been back.
People say it's cheap then spend months fighting parking scams with a company that's bolstering the gap in its bottom line with a rake off from a PPC.
Mrs. Fishy has now given up on all of them and using Ocado, wonderful products, good deals, and to date the service has been 100%.
And thereby hangs the tale of the power of the consumer.

The potential of that site to generate parking charges must be small beer in comparison to that of the UK-wide Aldi network. Please note, we are not a legal advice forum. Silly Aldi
Problem is that consumers continue to flock there in ever increasing numbers, especially when Frosty Jack is on special offer, a most wonderful accompaniment to their Albania-sourced Gourmet Pop Doodles - burp! Please note, we are not a legal advice forum. After a very nice confrontation, sorry conversation, with a member of Aldi Customer Service I can now say the matter is closed.
I informed the good lady that I had evidence of using the store and would happily supply the bank statement to prove this.
She informed me that Aldi did not want to upset or put off loyal customers and are not in the habit of charging people to use there stores.
I have now sent a copy of the PE charge and proof of purchase via email to Aldi Customer services who will forward to there parking department and I have been informed I will have notification of cancellation of the charge within 28 days.
RESULT, Can't say fairer then that.0 -

Good for you
Assume you have this in writing/email and something to ram up the "sunshine don't shine" hole of PE IF THEY IGNORE ALDI.
Why do Aldi lie when they say
"not in the habit of charging people to use there stores."
Come on, they must know of the vermin who prey on their customers ? Of course they do ?? Aldi employ them with a brucy bonus as well0 -
Call the local council planning department and ask them to make available the planning permission documents under the town and country 1990 section 225 and 222 for the advertisement signs making and offering a contractual parking arrangement upon the area of land known as your local Aldi.
This will be very useful later if they try the court root, especially if they do not have the planning consent.
As principle to Agent the contract given to PE by Aldi must be legal and lawful.I do Contracts, all day every day.0 -
I have now had email confirmation from Aldi stating that although I did stay longer than allowed as I am a loyal customer they will contact PE and get the charge cancelled

Well done, but to be confident this is well and truly dead, you do need written confirmation from PE. They are pretty efficient at getting cancellation letters out, but if it takes longer than say 10 days (or it's getting very close to your POPLA appeal deadline) get back on to Aldi to rattle the cage.
If necessary, keep your POPLA appeal options open - don't go to sleep on this just yet. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
