    the NEWBIES sticky thread tells you how to appeal a BPA pcn and has a blue text appeal as well

    In addition to the protection offered by the common law, there exists statutory protection from unfair terms in the form of the Unfair Contracts Terms Act 1977, the Unfair Terms in Consumer Contracts Regulations and the Consumer Rights Act 2015. The Unfair Contract Terms Act 1977 applies only to businesses and does not apply to consumer contracts or consumer notices. The Consumer Rights Act 2015 repeals and replaces the Unfair Terms in Consumer Contracts Regulations and replace the Unfair Contract Terms Act in relation to consumer contracts and notices.

    as its a BPA member appeal then all that is needed to start with is the blue text template appeal, nothing more

    if that fails you get a popla code

    then you use legal arguments at POPLA to try to win your case

    the ONLY thread to read and follow is that NEWBIES FAQ sticky thread, 3 threads down from the top of the forum

    it would help if we knew who did the parking management there, and pics of the signs if they say "fine" on them ?

    It didn't seem to have much in it so I thought you put that plus what I've written. There are hand written neon stars above the sign saying read the sign or pay the fine. And it's Premier PArk Ltd

    even if you expanded it (staying as keeper , not driver) the UTCCR isnt relevant as it was superceded last year by the CRA2015 as I pointed out earlier

    any issues with signage should be used at POPLA, as well as no landowner contract , POFA2012 issues , BPA CoP errors etc

    whatever you write they are unlikely to canel , even if you were the queen visiting cornwall

    it wasnt meant to cheeer you up , just to show you that you are using outdated law references that have been superceded

    I meant CRA 2015 , so have now amended my post to say 2015 (not 2012)

    ie:- if you are going to quote the law, at least use the correct one

    As per above advice, as this is a BPA member company then your initial appeal is the blue text in post #1 of the NEWBIES thread .. nothing more, nothing less, cut and paste exactly as it is.

    No need to go off piste and try to give additional or alternative info, as this is usually a very bad idea.
