Hi everyone, i'm hoping that some of you lovely people can give me some advice on what i can do next...
I succesfully had my ccj set aside by the judge last week on the 17th August 2016, in relation to a parking charge for overstaying at a Morrisons carpark on the 14th August 2014. I had moved out of the property months before and proved to the judge that i had not recieved any correspondence from parking eye at all, not a single letter. I only found out about the ccj, when i performed a free credit report check after failing to get a mobile phone contract ( i previously had an excellent score of 900 so couldn't understand it.) Now, i'm over the moon that the ccj will now be removed, but i'm worried about having to go back to court again to defend my case - i'm a worrier by nature and the upset this has caused me has made me quite ill, i was visibly shaking in court and was sick before hand so don't feel like i can put myself through anything like that again. If it wasn't for the fact that myself and my partner want to apply for a mortgage soon, i think i would of just paid the charge, but i am proud of myself for fighting back because it was so unfair of them.
Do i now need to get in touch with Parking eye myself (this would be the first contact between us) if i don't want it to go to court again and am i right in thinking that this case has now been re-set, so could i ask them if i can just pay the original amount they were asking for which was £85, or do i have to pay the full £185? I'm confused and unsure of what best to do, please help.

I'd contact Morrisons before contacting ParkingEye.
Did the judge give you any instructions about exchanging paperwork with ParkingEye?This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
If you must settle with them, then you'd need to ask them what they want for it, and it's likely to be £85 + whatever costs they've run up.
You shouldn't have any difficultly beating them in court properly and paying nothing, but obviously it depends on how much stress you feel that'd put you under.0 -

and you don't get your £255 back. If you win you do.This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
Thank you for replies, I've received a confirmation letter from the court for the ccj set aside and it also says on it that the court gives permission for the claimant to re-serve the claim form to me at my current address.0

We're a low-income family, so luckily I qualified for the help with fees, so have paid nothing.0

P.S. If you go to court and lose, you won't be up for much more than £185 and you will then have 30 days in which to pay and thus have no permanent record of a CCJ. http://parkingeye.parkingfine-appeals.co.uk/i-got-a-parking-eye-ccj/New members, please refer to "sticky" threads that are alwasys "stuck" at the top of this forum0 -
Thanks for your advice, I think I will email morrisons head office and see where I get with them, I shopped with them and used that car park for 10 years until we moved house so I'm hoping customer loyalty counts for something! Any pointers on what to put in the email and who to address it to are gratefully received 0

Just read some of the comments from that link ..."The letter was signed by Sarah Connor, Collections Manager" - no wonder MIL started using Matt Murdoch(k) as a fictional name.0
