    The house in question is 3 bedroomed. The OP is on his own so would only be entitled to the single person Housing Allowance. Not even that if he is under 35. The OP would have to make up the difference in rent IF he was allowed to rent the house. The OP needs to rent a place suitable for a single person, and leave the brother to rent the 3 bed house to a family who need it.

    And all those rules .... were introduced by the last Labour Government!

    Perhaps mother could change her will to give the OP a right to reside in the property with the reversionary interest to the brother/his heirs?

    Right a little more info - i am a full time carer for my Mom, i receive careers allowance, ESA support group, Severe disablement premium, Pip daily living and mobility both standard rate.
    i am 40+ have worked all my life and paid my taxes - but due to recent disability will never work again, not out to screw the tax payer, as some have said. Just out to claim what i am entitled to.
    Not bothered about the house being left to my brother, as he is eldest, it would seriously effect my benefits if i was to inherit 50% plus i have huge debts which would take this away from me due to me having to stop working.
    So when my Mom passes, i would be allowed to stay put but obviously not pay rent to my brother.
    So would i just have to rent a private flat or small house and apply for housing benefit to help with rent?
    Please advice.

    I suppose it all depends on what rent your brother is likely to charge you and what you could afford to pay. Put your details into this LINK and it should give you an idea of how much, if any, LHA you would be eligible for.

    I do believe that any rental agreement would need to be on a commercial basis.
