housing benefit question

Currently caring for mother and living in her home as not married.
Now when she passes the house is left to my older brother - he says i can live there but would like to make a profit it from it, could i get housing benefit to pay him?
I get benefits and wiould be entitled to make a claim for housing benefit, it is a 3 bedroom house so not sure what implication bedroom tax would have on me.

Advise please.

  • Renting from family and getting HB isn't easy, you need to prove that its a commercial venture on you brothers part, what I can't understand is why if you are caring for you mum and living in the house it can't be left to you as opposed to the tax payer forking out...just saying like.
    The bedroom tax would take 25% from your HB as you would have 2 spare bedrooms, I would also assume you would have to claim JSA if you are fit to work.

    That's not true, the OP would be claiming LHA not HB. Therefore the amount would be the one bed rate (shared rate if the OP is under 35) for his area.
    Unless I say otherwise 'you' means the general you not you specifically.

    There is no 'bedroom tax' on private rentals, the LHA is set according to the needs of the occupants. For example, the rate would be one room for a single person.

    There is no 'bedroom tax' full stop. It is just a benefit reduction.

    The phrase is in common usage, but as you'll note, I used inverted commas to show that it doesn't exist in reality. :)

    Perhaps you won't need to remain on benefits after your mother passes.

    Is there a reason why she's leaving the house just to your brother despite the fact that you've given up your life to care for her? You might be able to contest the will.

    We don't have any of the details as to why your mother is leaving the house just to your brother. But you should consider that as you have been living in the house and caring for your mother, you might have a right to be 'taken care of in the will.

    You would need to consult a solicitor.

    What's not going to happen is that your brother inherits the house and you get to live there rent and council tax free whilst providing him with an income from the Taxpayer. The government closed those loopholes several years ago.

    I have gone from wrag to support group confirmed over phone but no paper work yet through. I also claim careers allowance and get £248 per month and was getting £148 twice a month - today i got extra £22.90 added to account and £248 careers allowance added to bank - my wrag money £148 was paid wednesday 2nd march.

    any idea what the £22.90 relates to?

    is it 1 week difference from drag to support + £15.00 enhanced disability premium?

    Hope someone could explain as it is confusing me and i can't contact them till monday.

    Would the fact the fact that the OP is in a support group make any difference to his situation in the event of his mother's demise?

    Clearly he would lose the allowance received in respect of caring for his mother.

    Being in the support group doesn't make you eligible for LHA on a larger property, although it probably explains why the house hasn't been left to her.

    So the OP has to move out into rented accommodation elsewhere and will get housing allowance to pay the rent, and the brother lets the house to someone else maybe on benefits and gets his rent that way. Far easier for the OP to stay put and be granted housing allowance to pay to the brother. Wouldn't suit those on here, nor the Tory government but makes far more sense.
