Hi people,
My ticket fell off the windscreen and landed face down due to wind on Sennen hill top car park, got a ticket, I have appealed informally to them so they have my address (I know I should have just ignored it) - What should be my next move?
Also can anybody tell me the latest laws in this situation as it has all got very confusing recently.

Thanks, some great info in there, but the issue is that I have already given my address and told them it was my car by email from the first appeal.
So as a member of the IPC, armtrac say to appeal again against the PCN with the IAS, but the thread says that there is no point as I will lose.
There lettering is clear on the signs as far as i can tell? (wont let me send !!!!!!!s or pictures), that was not the issue, it was just the wind blowing it off as I shut the door.
So some say I should just ignore it, but then some say I could get sued?

they have 6 years to take you to court for non-payment of an invoice
that system has been in place since 1973 , its now known as an MCOL , google it
so if that is what you are asking , then yes , you could be "sued"
the only thing armtrac want is your money , as much as they can get , so your initial appeal will be or was refused, plus an IAS appeal is also likely to be refused as well
its heads they win , tails you lose , which is how they want the dice to be loaded , on the side of the "house"

Thanks, yes they have refused the initial appeal, as they will the IAS. The question I'm asking which is very hard to find the answer to is, in my situation when I had a ticket but it was face down, can I just not pay, or will they/can they take me to court/sue me, what is most likely to happen? And If i go to court will my proof of a paid ticket actually help me.
Are you saying that there is a 50% chance that if I do nothing after they start sending in threats to my home, I may get sued/taken to court?
Should I ask them for the details of the land owner and appeal to them? Do they even have to give me this?
Sorry for all the questions but I have been trawling the threads and nobody has given specific enough answers!

It's their move next in terms of what happens. But you could try to head it off by getting a landowner cancellation.
Try Google, try the Local Authority Planning Department, try the local Valuation Office. If you're prepared to pay £3-£4 you can get the definitive from The Land Registry.
But Armtrac Sennen has appeared on this forum (and PePiPoo) many times, so try a forum search 'Armtrac Sennen' and see what it turns up.

no you dont have to pay , not unless a judge says so
yes you can ignore them , forever , unless they try an LBC or an MCOL within 6 years
do not ignore an LBC or an MCOL , from Armtrac or their solicitors
yes you may get taken to court, many are since Beavis lost his court case , tens of thousands per annum
Armtrac are under no obligation to tell you who the landowner is, but if you do find out its not an appeal, its a demand , you demand that the spurious parking charge be cancelled
ps:- they are not invoicing you for not paying , its likely to be for not displaying , totally different
for example , when we had a road tax disc , you may have paid the money out but if it had fallen in the footwell (or inside out) the charge would be for "not displaying it correctly" , not for "not buying it"0 -

You can try to appeal to the IAS but as the system is incestuous, the chances are high that you will fail. It's all part of the scam to extort money.
They will ignore you regarding who is the landowner, answering such questions scares them as they might not have permission.
As Umkomaas says, you need to find out who the landowner is.
Forget the word "sued", they can only make a claim against you in county court. Will they ? nobody knows but if they do, it's no big deal, judges are wising up regarding this scam and especially where the IPC/IAS is concerned.
You say that the parking ticket was upside down, what do their signs say about this ... probably nothing but check them out.
Sometime back. i got a ticket in a council car park and by mistake put the ticket in my pocket, not on the dashboard.
I wrote to the council saying if you are going to take me court, I require a refund of the ticket enclosed proving I had paid the fee. And the clue in court is ... I have proven to the operator that the correct fee was paid but they rejected this
The purpose of this was that if they refunded me, they accepted I had paid ..... if it went to court, the paid ticket would be presented to the court. This probably sent a bolt through their scamming brains and the ticket was cancelled
In my book, you fight *hit with *hit especially when dealing with a cesspit like the IPC/IAS and the owners Gladstones Solicitors.
Do check what the signs say, you might be amazed at the stupidity of these cowboys .... oh and yes, fight for your rights0 -

So what is the difference between being invoiced for not paying rather than my case which I'm guessing is not displaying?
Also I cannot find out the details of landowner anywhere does anybody have experience of this particular car park?
