Mis-sold packaged account - advice?

Hello
I have written to HSBC via resolver about my HSBC advance - I wondered if anyone had any thoughts / advice on my chances of getting the money back?
I opened the account in September 2008 so have had it almost 8 years. When I opened it the sales assistant was pushy and didnt tell me a free account was available. I am pretty sure I was told the fee was 5 and then they put it up to 12 at some point.
Am I likely to get refunded? Does anyone know how long they hold on to phone recordings?

No-one knows what the bank will do, they may autopay to get rid of the case, they may fight it. What you have described is a typical hearsay complaint which you can't prove but they may identify other failings. If they have sent you details of the account in the past explaining the features and fees, they may time bar it. Do note sales staff are there to sell things, there would have been adverts and leaflets in the branch and on the web about the free accounts, if you didn't want to pay for it, you could have left the branch. All that is why it's impossible to tell, you'll have to wait and see
Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

We dont have acesss to the audit trail. So, no-one can say.
There is nothing wrong with having packaged bank accounts. So, its not a product issue. It really comes down to what evidence exists to support your allegation and if there are any other identifiable issues.I am an Independent Financial Adviser (IFA). Hi sorry to jump on here I'm new on this site was wondering who was the best company to use to do the claim for you? Over the years I have had mortgage credit cards with hand and barclaycard I've also had a welcome finance loan however I don't have details of these accounts anymore apart from the mortgage but was told I can't claim that back because it was sorted out by a broker. I've also had car finace through Vauxhall using Blackhorse, I would love to do it myself but genuinely don't have the time or the energy to do it due to my current situation.0

None of them.Over the years I have had mortgage credit cards with hand and barclaycard I've also had a welcome finance loan however I don't have details of these accounts anymore apart from the mortgage but was told I can't claim that back because it was sorted out by a broker.
A claims company wont know that either unless you tell them.
Brokers/advisers are not seen as a failure in the PPI issue. They account for under 1% of PPI complaints and most of those get rejected (mainly as its only MPPI that they dealt with and MPPI is considered a more important product. It is still one of two types of PPI still retailed today).I would love to do it myself but genuinely don't have the time or the energy to do it due to my current situation.
In which case you dont have the time or energy to deal with a CMC either as they will take the same time to find out and prepare the complaint (possibly longer as you need to enter into a contract). So, if complaining free of charge is too much of a hassle, then paying to complain via a CMC is going to be as well.I am an Independent Financial Adviser (IFA). Think carefully before entering into contractual agreements in future!0 -
Hi,
I think the resolver tool on the money saving expert site is good - that's what I did although I havent had a response from HSBC yet.0 -
Don't you think it's little premature to recommend it ?goatelope16 wrote: »I think the resolver tool on the money saving expert site is good - that's what I did although I havent had a response
Wait until you have successfully completed your complaint.0 -
I was not responding based on the result of my claim, since it may simply be that they dont pay out, but on the ease of the site to use, the fact that is is free, the fact that is is recognised by the Ombudsman, and the reviews of it online and on here. Thanks.0

We were mis-sold a current account package when my husband was self employed. Used Resolver, Lloyds rang us next day and money in account a day later £600!! Thank you so much it was so quick and easy. :T0

Self employment is not a reason for mis-selling a packaged account. It sounds like your claim was settled because it was under the auto payout limit, basically meaning it is cheaper to pay out than for the complaint to go to the ombudsman.0
