I have just been advised, by a regular on this forum, that I have a) screwed up my 'appeal' (unintentionally, obviously) and b) will spend the next 6 years receiving debt collectors letters and possibly court papers. The fact I didn't receive a ntk (which I had thought was in my favour) apparently is minor and will be overlooked by the judge. Not sounding too promising really. As someone who suffers from anxiety (not saying this for any purpose other than to explain my reasoning), taking into account all of the above, I believe I would have been better paying the charge and going on my merry way! Sorry if you disagree. But that is surely subjective and will be individual to the person depending on their character/ time/ financial circumstances/ mental health and probably a host of other things I haven't mentioned. I am not sure what to do from here, in light of the previous response I received, and am therefore currently regretting not paying!!! If you have a constructive suggestion re where I go from here, or if you think i have been given inaccurate information, then I would love to hear about that.

    Please don't twist my words. If it ever got to court a judge MAY overlook it, but others will not - you may have to explain to the judge why the keeper is protected by PoFA . We would help, but don't anticipate having to do so.

    NPE have never, to our knowledge, taken a parking case to court. Why do you think you will be their first?

    How 'costly' do you imagine a court case would be? They want you to pay £160 now. If it went to court and you lost, it would likely be not very much more. If you won, it would cost you zilch, and NPE would pay your costs.

    Once again, you are twisting my words!

    You failed to provide your name and address; it did not change what the outcome would have been. Almost very IPC PPC appeal is rejected and that would leave you in the same position as now - being chased by debt collectors. The fact that no NtK was served was part of the strategy in appealing early and works more in your favour than had you waited, without appealing early, for one to be issued.

    You will receive a flurry of debt collector letters over the first few months, then it will all go quiet - just as it has for tens of thousands who have received advice from the various parking forums. It's after it goes quiet that you just need to be on the lookout for the very, very unlikely event of court papers dropping through your letterbox.

    Even if you are contemplating paying, now is not the right time. The Government are looking very carefully at the private parking industry (via the DCLG) and announcements are likely in a few weeks. You would be extremely premature and rash to jump now without understanding the full ramifications of the Government survey, subsequent deliberations and decisions. The level of charge will not rise in the meantime.

    I'm sure £160, as Christmas approaches, is far better in your pocket than in the PPC's, to fund their next Caribbean cruise, new beamer, or First Class airfares! Think about it.

    I speak from experience with this clown, you get a non POFA NTK if you get one, loads of garbage from DRP and Zenith, same crooks, more garbage from DRP dressed up as coming from Small Claims Solicitors or Gladstones. This fine upstanding one man band with a Police Caution for VAT fraud at present keeps well away from court.

    Photobucket doesn't work for me (and some other regulars), so please host on Dropbox, imurg, tinypic so we can view whatever it is you've received.

    Maybe a short written description of what it is in your posting might save us chasing around links, especially if it's a standard element of the usual chain from debt collectors.

    The clue is who does it say pay? Ahh DRP so guess who sent it, safe to ignore. They also use SCS letterheads.

    Anyway, it is the normal junk pimped out letterhead saying to
    pay DRP and quoting the Beavis case and even stating that it's now law ??

    The normal stuff about who to contact if you cannot pay but
    of course no mention of Trading Standards.

    Once again, this is another misleading letter and the OP should
    send a complaint to Trading Standards

    The Beavis case does not apply to the OP and it must be
    deemed as menancing to extort money.

    They also make threat of a CCJ and all this before a real
    court judge can have his say

    TRADING STANDARDS MUST BE INFORMED OF THIS FAKE

    No, a complaint should be from the heart and individual. Look at misleading business practice as defined in the CPUTRs (Google those regs then search them for the word 'misleading').

    TS will look into breaches of Consumer legislation, or misleading and unfair conduct.
