Parking ticket in water world

I have read the main post, and before I had already come here I did a few things, by the looks of it - stuff I shouldn't of done. Is it too late to issue a complaint to POPLA? Have I messed things up badly?

I'll breifly explain:

I went to water world, with my family. On 7/5/2016 where I paid my ticket. We used water worlds facilities, got food in three and purchased googles from their store. Was a nice day out untill my little girl hurt herself. This is where I had over stayed. She didn't require a first aider was just a burn and she dramatised it and I had to calm her down. To be honest I totally forgot to pay the rest of the ticket I think it was an hour over due or something like that, was too busy making sure she was okay.

I didn't recieve any PCN letters, but worse...around a month later I received a debt recovery notice from DRP. I was fuming..,so I rang them up and basically gave them abuse over the phone saying that they hadn't even sent me a PCN. They said I had to take this up with Royal Mail, I said well you can't prove you did or did not sent a letter to me. I never got one or I'd of paid it there and then (which I would of done if I did receive one). Then I told them their company was a joke and they could take my !!!! to court and I'd pay the, £1 a month not a penny more and would ignore all letters from them. Then hung up in the phone.

I now received an instalment offer, which I have ignored and went to contact water world moaning about the charge and lack of pcn notice. This is what I wrote

I visited water world on the 7th may 2016. I paid the car park fee. Then over a month later I get a debt recovery notice saying I owe 160 quid to smart water for over staying the parking fine.

I did not revive any fine win thin 14 days, and not even reviewed the original fine from smart parking Ltd.

They are trying to take me to court over 160 quid, I bought food for my family, I paid for the slides and bought extra stuff in the store for my little girl who got hurt in one of the slides so we went home earlier.

The debt recovery is DRP and apparently smart water Ltd wont contact me. I am not paying the 160 quid as this is highly unfair, I will happily pay the extra £1 or whatever it may be now for the extra hour I stayed due to having to calm my 5 year old daughter down due to hurting herself!

I shall not be visiting this place again as no one can manage their own systems and only one of the machines worked which was the one right at the back.

This needs to be sorted out as demanding money like this is not right, I understand people do not use the car park as it should but I can provide bank statements that I used your facilities and entered water world. In fact you'll even have it on cctv I imagine.

Any further contact from DRP shall be ignored and will be considered as harassment. They couldn't prove they sent the original fine out. This shall be sorted through water world only, not anyone else. I shall be informing DRP of this as well.

I also want the contact to email, and strictly email only. I shall not be giving my number out to anyone.

If you would like photos of the letters I have received I can supply them.

They replied saying they would investigate with smart parking and I sent a photo of the details in the top right corner. That was today

I feel like I have totally done the wrong thing about contacting the debt recovery company, and now feel contacting water world was wrong after reading the main post. Am I doomed now? Or should I still carry on with complaining to POPLA

    I wont be commenting on your war and peace, but suffice to say , yes we know , we have seen it all before , it is unfair , get over it and fight back

    I will say this though

    you should ALWAYS complain to the landowner, so in this case waterworld , and get it cancelled , no doubt about it

    if not so SMART have rejected your appeal , then they should have issued a popla code, if so , use it before it expires and hit them with a popla appeal as well, based on legal arguments (not your story above)

    so landowner complaint , tick - done

    popla appeal - draft one up and get it checked and then submit it promptly, before the expiry date of 28 days later

    if its too late for POPLA , then get the landowner to cancel , and ignore ZZPS , DRP and any other debt collector

    SMART have 6 years to try a court case

    You should edit it imediately and take out the traceable details!!!!!

    DR+ will not and cannot take you to court, only the landowner, or not so Smart can, and DR+ have said their usual lying waffle "we have advised them that court action should be taken"

    They haven't, if they did DR+ will be out of the loop and get nothing it's a pack of waffle.

    Follow Redx advice, and The Deep has the right idea, treat them with the contemp they deserve.

    Hi it's me but I've stupidly forgot my email address to log in so used this account which originally didn't exist according to money super market and had to create a new one but nevermind.

    RedX - ahh that's good as I contacted water world just waiting for the outcome of their investigation.

    As I never received the original parking notice it's been well over the 28 days. It's now August and the date I went to water world was all the way back in May. Take it, it's way too late now. I'll start to draft one up anyway just Incase.

    Yeh at first I panicked as I live with my mum and dad and it's their house, and their stuff. So rang them up.

    Zardoz70 - yes that's the one, that's the email I contacted to send that email to water world and waiting a reply back after they investigated.

    You'd be their very first one - ever! Half a million tickets issued in the past 18 months and never been anywhere near a courtroom.

    Just with smart parking? That would be my luck to be taken to court. I hope water world stop the ticket, and it ends but I have a feeling it's going to be a bit of a battle. I'm unlucky :(
