NHBC claim - Log retaining wall in garden

Hello just wanted to share my issue and ask advice.

We purchased a house in 2012 from a well established local builder in Leicester (Jelson) which has NHBC cover.
We had several issues that the builder rectified but 1 issue which we raised was with a log retaining wall in our rear garden for which we had to use NHBC resolution service..
Our garden is on 3 levels with retaining walls between each level and there are also large (almost 1m high) retaining walls with at the boundary with another property.
All of the walls are built with treated logs but within a year some of these started to show signs of rotting and in some places earth started to pass through.
We raised our concerns, Jelson were not interested so NHBC sent a claims advisor.
NHBC produced a report saying that their standards had not been met and suggested that a membrane be installed behind the logs within the garden to stop more earth passing through. They also suggested the the logs were treated and would not rot and this it was just fungus that could be scraped off. There was no recommended action for the walls at the property boundary and Jelson carried out the work required. Although it was not in the report thr NHBC claims advisor stated that as the issue was raised within the first 2 years and standards were not met that NHBC would have ongoing liability.
Now 3 years later (we have now been in the house 4 years) the logs are rotting and one the log walls joining to another properties garden is beginning to give way.
I have arranged a site meeting for this friday with Jelson but do not expect them to help so have also re raised the claim with NHBC.

The problem is the NHBC say that this would be a new claim and is not covered. I disagree, I think this the same claim and same issue and that they should either get the builder to put right the issues to NHBC standards in first place or force them to do so now. If the builder is not willing to do so then surely this will be covered by NHBC.
I have progressed the claim with NHBC and will keep you updated but wanted to know if anyone has any experience of complaints about NHBC or referrals to Financial Ombudsman if NHBC have not upheld their own standards.

    Hi, I stumbled upon your post when searching for 'Jelson'. If you don't mind me asking, which development did you purchase on and would you recommend it? I'm contemplating purchasing one of their 2 bedroom houses. Would you recommend them overall?

    The logs should be tanalised ( Treated) and i'd expect a DPM to be laid.

    I'd also question whether they have dumped contaminated spoil in this area.

    I am in the process of buying a Jelson home as well so I hope their are no issues. Although searching the internet there aren't really any complaints about Jelson. Out of interest did you end up going for a Jelson home? If so, which development.

    Yes, it's difficult to find 'reviews' of Jelson's, or any other homebuilders' homes online.

    I haven't as I've recently started a new job so will have to wait for the probation period to end. I was considering the Blaby development. What about yourself?
