Returning a tv that is faulty (littlewoods)

Hi.

I bought a new TV from littlewoods on the 30th June and it was delivered on the 12th July. It was bought to be placed in our new house so was delivered to my partners mums address and kept there until we were able to get the keys to the new place and get flooring etc sorted... We have now moved in but unwrapped the Tv today and found that there is a large portion of the screen that is not working as intended).

I called littlewoods who said although just within 28days as we hadn't checked to see if it worked correctly within 48hrs of delivery they are not liable to replace it and cannot help further. I obviously argued this and they said if I call Panasonic that they might inspect the tv.

Can anybody tell me if I am within my rights to have the tv replaced under consumer rights law or if what they are saying is actually correct. Any help would be appreciated!

    I would suggest that you point out to Littlewoods that under The Consumer Rights Act 2015 you have up to thirty days to confirm that the goods conform to contract.

    As it has been found that the television does not conform to the contract, you have every right to reject the thing and Littlewoods must, if requested, provide a full refund.

    This is known as the short term right to reject and is described MSE's Consumer Rights guide, where it says:
    Get a full refund within 30 days

    This is a nice new addition to our statutory rights. The Consumer Rights Act 2015 changed our right to reject something faulty, and be entitled to a full refund in most cases, from a reasonable time to a fixed period (in most cases) of 30 days. After that, you lose the short-term right to reject the goods and you'll have fewer rights, such as only being able to ask for a repair or replacement, or a full or partial refund if this doesn’t work.

    If the item is faulty (not physically damaged), then of course you are entitled to a repair or replacement.

    If however, if the large portion of the screen not working is because it has been damaged then Littlewoods have a point in that you can only have a limited time to report that the damage happened prior to you receiving it.

    How did you manage to transport the TV from your Mother In Law's address to your new home? Could you have damaged it yourself during transit? I hope you didn't lay the TV flat in the back of your car? Modern TVs have to be transported vertically.

    You need to provide more information than simply saying a "large portion" of the TV does not work as intended. What does that even mean?

    forget the 48 hr thing , the TV has gone faulty between the date it was delivered and now


    "littlewoods , I newly bought TV has gone faulty , please repair or exchange "

  • When turned on its like the colours have ran down the right hand side of the screen.

    It was transported in a van, Upright and tied down so not to move it.

    During the time it was at the in laws it was left upright and not touched until this afternoon

    So why did Littlewoods respond as if it was physically damaged, I wonder?

    As already stated, if the item is faulty you can reject it and demand a repair or replacement.
