    I have it in an email and they are sending in the post too. I'm still going to file the initial defence. I wouldn't be surprised if excel pursued it anyway.

    You MUST still file the initial defence and rather than disseminate HO87's version, I would go with that one and when you get the letter from the principal you can write separately to the court and Excel/BW Legal requesting that the claim be discontinued.
  • I submitted the defence as haven't heard anything and I've had confirmation they have received the defence, have double checked with the peel centre who assure me it is being cancelled.

    But I wonder if they are going to pursue it in the hopes we just drop it now that cancellation has been promised.

    Does anyone know the normal time frames for the next step? Also, how would I apply for costs? Via my own small claim?

    You need to wait and see if you get a Directions Questionnaire (this month, probably) if so, come back here as you will need to complete that & return it (with a copy to the claimant as well). At that point, you can call for the claim to be struck out by the courts, as the principal has cancelled the charge.

    If you hear nothing in September it would seem likely it's been discontinued.

    well done , they dont cancel many , if any at all, so +1 is better than none :)

    its surprising that they let it go this far considering you posted for advice on here over a year ago and got nowhere with any of them
