bear in mind that none of you are the registered keeper , so remove the word REGISTERED if nothing else from the HO87 reply
the hire co is the RK , the lessee is the keeper , so somebody in your family is the keeper, nothing more
if one of you owned the car and had your name on the V5C , then REGISTERED KEEPER was correct (so anyone else reading this and using this thread for reference , take note)
good luck0 -
Just to let you all know that the part 18 request went off yesterday to both BW legal and Excel, with proof of purchase.
Any advise on when to submit the outline of defence? Later rather than earlier? We have until September.
There is also a leaseholder at the peel centre, and the property manager at the peel centre helping me, they have asked excel to "quash the fine" (yes, I know it's not a fine!) but with no joy. But that should help in court.
I have included a line in the defence about seeking to prove that the landholder have requested that this is cancelled and not taken further.0 -
Fantastic post HO87, I take it this is the skeleton defence that is to be sent back on the initial MCOL defence? rather than the full defence?
Thank you0 -

Thank you
yes , like he says in his opening commentsThe system allows you to make a final submission late in the process and so this is intended just to lay down the foundations of a final version. For that very same reason I suggest that not too many facts are disclosed at this stage on which Excel can then base their case.
these issues are not just "copy and paste" , but READ and AMEND as well
the full defence would have more detail and information about court cases and laws as well0 -
HELP!
I'm in a similar position as the OP.
I'm in dispute with Parking & Property and have received a Claim Form from Northampton County Court.
Previous appeals have been in the name of the registered keeper (my mother, who's 82) and the Claim Form is addressed to her.
What to do?
As much as I don't want to cave in, I've no intention of dragging her from London to a court appearance in Northampton.0 -
start a new thread of your own using the RED new thread button , on the main forum , top left of the page
then you will get bespoke advice for your own circumstances (especially as its not the PEEL CENTRE or Excel either)
there is no "court" in Northampton for you to go to, its the main processing centre and any court will be nominated by you , near you
edit
now in this thread here

turns out its not in his or her name at all, but the elderly mothers name0 -
Peel have asked excel to cancel the PCN.
this should be interesting.0 -
well done , be interesting to see how you get on , try and get this in writing as it would be useful to have as evidence if it actually goes to court
ie:- the landowner on your side , which is a first in my book0
