Quentin, some years ago the DVLA tried to do me out of £14 refund of RFL. I fought and fought , but they were obdurate, eventually, they caved in, but it must have cost them hundreds of pounds. It certainly cost me a lot of time but sometimes a principal has a worth beyond rubies.

    Full story here.

There doesn't appear to be a POPLA code provided. The company was Rapier Park*ng.

This is the kind of corrupt & unscrupulous practice one would associate with the old Soviet bloc and will certainly taint our holiday memories of the UK.

Are you sure it's Rapier Parking (if it is they've certainly 'raped ya' as they'd have no access to the DVLA database to get your details), or do you mean Napier Parking, if so you've even less chance of a refund than from your commoner garden PPC.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So you spent all this time fighting and fighting DVLA for £14 and get satisfaction having cost them "hundreds of pounds" - but what was the satisfaction in that - who do you think they got those hundreds of pounds from?

And what has the worth of the head of a school got to do with all this anyway?

I got the satisfaction of having beaten them, just as I have beaten the Vatman, British Gas, NatWest, Fiat, Alfa Romeo, Reading Borough Council, Amazon, Thames Water, my landlord, Orange, Royal Mail, The A.A., and many more.

Except when it involves correcting someone with this attitude towards spelling/apostrophes/correct use of the word "summons" etc etc

Seems you don't mind such errors but only if you make them??

Probably a silly question this, as all the advice is NOT to pay a parking fine before completing the appeals process. However on receipt of an utterly unjust & unreasonable parking fine (in my view), which the driver had no intention of paying as he is from another jurisdiction and presumably could not be tracked down through the DVLA, one of his passengers naively paid the £45 (discounted price) fine themselves. I am certain there were good grounds for appeal as a valid ticket had been paid for and displayed. Is there any point in appealing it to POPLA now? (An appeal has already been made to the issuing company and refused.) And if the appeal was upheld would there be any chance of getting the money back?
There is more chance off bumping into elvis presley in your local chip shop .
PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue.
  • At small claims court you can claim 4 Xs the amount owed plus the £90 for submitting a claim. So if it's £45 you can claim £180 + your £90 for the action.

No firms ever contest a small claims court claim as it's not worth the hassle or bad publicity (my daughter and her mate had their landlord refuse to refund their £200 each deposit on a rented flat a couple of years ago. I spoke to him and he was so obnoxious I footed the cash for a small claim. I wasn't bluffing and one morning two cheques for £845 landed on our doorstep).

Yes you have to gamble £90 but if you can afford to risk it and you have the courage of your convictions you can actually shaft them for some cash.

I admire your zeal but quite where you get the idea you can claim back four times the amount you actually lost - unless you can justify that by way of additional costs is beyond me. Bear in mind that you make this assertion on a forum that advocates pressing PPC's to account for every penny of their claim.

I think you may also be underestimating the vigour with which private parking companies defend their business model - especially if we are talking Napier Parking.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
