Any possibility of refund?

Probably a silly question this, as all the advice is NOT to pay a parking fine before completing the appeals process. However on receipt of an utterly unjust & unreasonable parking fine (in my view), which the driver had no intention of paying as he is from another jurisdiction and presumably could not be tracked down through the DVLA, one of his passengers naively paid the £45 (discounted price) fine themselves. I am certain there were good grounds for appeal as a valid ticket had been paid for and displayed. Is there any point in appealing it to POPLA now? (An appeal has already been made to the issuing company and refused.) And if the appeal was upheld would there be any chance of getting the money back?

    Nothing 'probably' about your question! If it's paid, it's paid, no PPC is going to refund.

    Was the company daft enough to provide a POPLA code with the rejection of the appeal letter?

    Which company?

    PS - it was not a 'fine'!

    You can write to them, they'll reject it saying that the payment was acceptance of liability.

    The only way to get your money back would be to file a small claims action and beat them in court over it (which you should be able to do, but it's a lot of work).

    Just make sure the passenger never pays again :)

    The op or passengerwill be spending much more than £45 in court fees and their time in pursuing this to a hearing they are not guaranteed to win!

    Even if they won they would end up out of pocket in terms of the time and effort involved.

    There doesn't appear to be a POPLA code provided. The company was Rapier Park*ng.


    This is the kind of corrupt & unscrupulous practice one would associate with the old Soviet bloc and will certainly taint our holiday memories of the UK.

    You won't have gotten a POPLA code if it was paid without appeal. Which is a shame because they can almost always be beaten at POPLA without paying anything.

    We feel the same about the practice - unfortunately enough people just pay up to make the scam worthwhile.

    Does that mean you're not in the UK, and were just visiting? If so, it's definitely not worth trying to claim back the £45.

  • The way to get a refund is contact the retailer or land owner, and get them to contact the parking company on your behalf to ask them to refund you money. Refunds are achieved this way quite often.
