ZESTR, apologies for the late response. I haven't logged in for ages.
I've since had a mediation session which was a complete waste of time. The government mediator was clearly not on my side and kept threatening me that if I don't pay then the costs will go up. Note that BW legal did drop the settlement amount substantially when I said I have evidence that some new clearer signage now up at the car park entrance was not there at the time of my incident. However, they still wanted over £150 so I said I'd rather go to court than even give them a penny.
My date is set for April now so I've got my witness statement ready with the help of a friend who is a lawyer.
I've read online that they sometimes drop the case 7 days before court so I'm intrigued to see what happens next.

On your own thread, please show us the WS and the evidence you will be submitting with it. Happy to hear you have had advice from a solicitor but not many would be familiar with the POFA and parking law like we are.

Hi Everyone,
I have some good news to share. My case (as per original post) went to court today and I won.
The only argument from the claimant BW legal was that there was no chance I could have missed the signage.
Various things went in my favour:
- the contract between the landowner and VCS was illegible and seemed to have been signed in 2011 and at that point it was only valid for 1 year. The judge wasn't convinced that the contract is binding to the time when I got the ticket.
- My images showed that a clear entrance sign now exists but it was not there at the time of the ticket. The judge agreed that if I got the ticket since the entrance sign was put up, I'd have lost. However, none of the signage was obvious and the judge agreed that the fact an entrance sign is now up, shows there was an issue.
- In BW legal's evidence, they included a photo of my car with a sign circled next to it. They didn't realise that there were 20 PCN's stuck on the wall in the same photo! I used this to argue that lots of people were caught in the days before my incident so if the signage was so clear, how could that happen.
Absolutely over the moon that 2 years of stress is done with and I don't have to pay a penny. Justice has been served!0 -
