Accident and no claim bonus question (URGENT!)

What do you think who is responsible for the crash in the following video.

I think the red car is responsible because he drove behind the van while it was moving.

If the van is responsible for the crash how will this affect our fleet insurance, which is £3500 for six vans?
I would like to know how much our insurance will be after we lose our many years no claims bonus.

I haven't watched the video but if the van is deemed at fault then it's really only an answer your insurance company can answer as it would depend on;


Have you got protected NCB?
How many years will you lose if it's not protected?
How heavily do they increase their premiums due to claims?


I'm sure people will give you an opinion on the video but really it's up to the claims teams at both insurers to decide if nobody is going to admit liability. It is then up to the underwriters to decide what happens after that.

To me it is the vans fault for reversing onto the road when it wasn't clear to do so.

Agree with tberry6686, van at fault in my opinion. You can't just reverse into traffic and assume they will stop

You say you need "urgent" advice over this


In which case go to the horses mouth (your insurer or broker) who can answer your questions


No-one here knows the terms of your policy/how many years NCD you lose after a claim/is it a discount applied per vehicle or across the whole policy etc etc

Van should have checked for any moving vehicles before attempting maneuver. Why not just take the extra 30 seconds and turn in the car park?

It might end up as a 50/50 to be honest because both cars should/could have stopped but this would be wrong if so. Van driver at fault in my opinion.

It's like when people assume signalling gives them the right to commit to lane changes regardless of who else is around.

it appears the van driver stopped looking in the direction of traffic flow before he began moving again, probably after spotting the two cars he assumed no others would appear and failed to check again before resuming his manoeuver.
Is this a public road? it's normally assumed any driver entering the main carriage way is at fault as it is his duty to make sure the way is clear and I have never heard of any excuses or reasons where the opposite is accepted.

Impatience all around, van driver reversing out hoping everyone will give way and possibly the cars taking exception to the way he just reversed out?

If the van driver worked for my old firm they would have him take lessons and a mock test to see if his driving standard was actually upto the job. The red car could have stopped and give way but he didnt and the van backed into him. The car should have been clearly visible.

The car driver would be about 20% liable for the fault at most. They seen a hazard approaching and didn't take any measures to avoid it.

However the van driver is primarily at fault. He reversed into the side of a vehicle already established on the road whilst trying to join the road.

This is the reason I always say you should reverse into a space/car park and then drive forwards onto main roads.

Even though the car could have prevented the accident by stopping. I would say it's fully the vans fault because he was the one joining the main carriageway in reverse without being observant enough.

I would also implement a policy where everyone must reverse into spaces in the car park. Then they would always be facing forward's when driving out onto the main road.

Agreed, it's much easier to drive forwards onto a main road, you get a better view of the traffic.
