the signs are small and unlit and the vehicle was parked at night when it was dark
Thanks in advance for any further advice0 -
UKCPS v Gaskell is the case you need. Signs have no clear terms especially at that time of night. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0

I have received a letter from Miah Solicitors threatening court action relating to the first PCN

I am thinking of getting help from privateparkingappeals.co.uk - would they deal with this kind of thing?0 -
most of those people are unfortunately PPR,d from here as MSE does not like them at all
but you could try them if you wish , no guarantees but you never know , they might take on IPC cases but didnt at one time mainly due to the Beavis result last year0 -
Plenty of Miah threats kicked into touch via mse, despite the ttravesty of Queen coupon-mad and others having been ppr'd.
Joseph123, we all realise you are having to do much leg work on these, but it IS your way to success. Google: miah solicitors+parking prankster.

Apologies for my ignorance but what does PPR'd stand for?
I would argue that the Beavis case is not necessarily comparable as
a) this is a non commercial car park with no option to pay for parking. The car park was empty. There is no financial loss to the landowner.
b) the signange is unclear, below eye level (at ground level) as you enter the car park
c) the vehicle was parked outside of operating hours of the health center
d) the signange is unlit and the vehicle was parked in the evening and night therefore I refuse to accept that any contract was entered in to
UKCPS also said in their letter to me that the vehicle was not displaying a valid permit. However there is no instruction on permits and no mention of them in the signange. All its says is that you must stay on site or face a fee. UKCPS clearly has no idea about how this specific car park works and has just sent me a stock argument. To me the whole thing seems like fishing to catch people out. There's no machine or option to pay for parking but someone is clearly hanging about at all times of the night waiting to dish out PCNs.
I wouldn't mind taking this on myself if that's what you advise on the forum. From briefly reading what I found on Miah and UKCPS the first thing to do would be do ask Miah in what capacity they are operating?
I would appreciate your advice as to whether the wording on the signs meets the criteria for a 'contract'?
I would also like to contact the landowner and ask them to discontinue this unremitting harassment. I wouldn't mind paying them a smaller fee just to get rid of this headache. I am weary of offering to do so in case such an offer could be used against me further down the line?0 -

not just CM , but others like BOD too
the forum rules describe PPR
and yes use the GAN letter to fight back , bearing in mind that the MIAH desk is probably in the same room as all the other UKCPS desks , in the portakabin behind that pub in leeds0 -

Thanks, I have been trawling the pepipoo forum for the past hour and am slightly overwhelmed! I'm trained in the medical field - law isn't my forte - so a lot of what's on there is going way over my head  . I searched for 'Gan' and there are hundred of results, he has thousands of posts. If you know where these letters are could you possibly post a link?
Would it be worth me starting a thread on Pepipoo?
Thanks!0
