I'm getting confused now.
This post says what I posted is the exact opposite of what you said but then you post the same thing that I posted e.g. you are saying that if I found £100, handed it into the police, then received it back as it wasn't claimed then the person who lost it had 6 years to make a claim against this money.
Can you provide a link proving this?
I also said there would be a defence to the claim.
As for providing a link proving this, I have. The statute of limitations which sets the limitation period for actions founded on tort. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

You said that the person who had lost the money had 6 years to come forward and claim the money.
I don't believe that your tort link does prove that.0 -

No she didn't, not exactly ... she said that the statute of limitations is 6 years.
If you find some money, hand it in to the police, the rightful owner doesn't come forward within a prescribed period (I've no idea if 6 weeks is correct) then the money legally becomes yours.
If the original owner subsequently comes forward, contacts the police and they happen to give out your details ... in theory the original owner could make a claim against you for the money. You would have a cast-iron defence that you followed legal process and that the money legally became yours - the claim would fail.
That doesn't stop them making a claim - anyone can sue anyone else for just about anything - just that they're highly unlikely to succeed.0 -

I didn't say they have 6 years to come forward and claim the money, I said they have 6 years to chase for the money and that the OP could shorten that by taking it to the police (ie taking reasonable steps as they have a duty to do).
What do you think the action would be founded on if not tort? Contract? Deed? Statute?
Theres plenty in my previous links to support that the original owner still has legal ownership despite it being in someone elses possession. Why would you think that they wouldn't be able to bring a claim for something that is legally theirs? You keep using that word. Only MSE could make such a simple situation this complicated.
1. Take cash to police station, explaining when and where you found it.
2. Let bank know, giving them the same information plus police reference number and contact details.
3. There's no 3. That's it.
Or
1. Take cash to bank, explaining when and where you found it.
2. Ask for a receipt just in case.
3. There's no 3. That's it.0 -
So my qualification/description of the process (the rest of my post, which gives my understanding of what devil woman was saying) has no bearing at all on the first line of my post?
Not really no. It was just a bit of waffle.
The poster said that the person who had lost the money had six years to chase it. You said that isn't what she wrote. so I just posted what she wrote.
Although frankly I don't really see why you two are even posting about the six years rule, it's muddying the water on an issue where this doesn't even remotely apply.
If anyone can post a reputable link (ill even except the Caerphilly observer) where a person had to hand over some money that they had found, handed into the police and then being given it back. Then six years later were sued by the person who lost it then I will apologise and withdraw my objection....
Until then I will withdraw this thread as I don't want to get into another argument with you two as I know you both like to be a bit gung-ho with the report button0 -
A police officer friend of mine once told me that if you find cash all you need to do is ask out loud if anyone has lost any money. If there's no reply you can keep it.
That's just silly. This is not your average police officer, he is high ranking and is renowned in the force for his knowledge.
I'm sure he has a high opinion of himself, but policemen are very rarely experts in law.0 -

You've already had links, its not our fault you don't understand the information contained in them.
As for reporting, while I have no idea what bods reported in his time on here, I can count on one hand the number of posts (not posters) I've reported (excluding spammers). Neither of them were aimed at me (nor were either of them you btw - unless you're a multi). For 10 years on a forum, I'd say thats anything but gung-ho.
But hey, you've never let a little thing like facts get in the way of your opinion before, so why start now?You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
