Living in a house which has deferred payment for house selling (step nan in care home

Hi.
My step nan is about to go into a care home so I was thinking I could move into her house and pay her rent.

She is planning on funding the care through a deferred payment scheme through the council whereby the council pays now but when my nan dies, the house will be sold and pay the council back.

Will the council mind me living at the address and paying council tax, bills etc there?

    Is your step-grandmother likely to move back to the house from care?
    Does your grandfather still live in the property?

    If not, is there any reason why the property can't be sold now?

    The Ts & Cs of your particular council's deferred payment scheme will tell you the exact answer, but as a general rule of thumb, the sale shouldn't be deferred if there's no good reason. A step-grandchild wanting to move in and pay a (presumably) below-market rent is not a particularly good reason.

    Does your step nan want to run a rental business from her care home? Which is what she would have to be doing, with all the obligations that go along with being a landlord.

    It would not be a rental business per se. I'd sort anything out that went wrong.

    I just see it as a reasonable way to help with her care home fees.

    You have made me consider something though, Would she have to do a self assessment as someone who receives a rental income? :/ That could be difficult for her.

    You will be paying her rent to live there and therefore, irrespective of the family relationship between you, she incurs all of the legal obligations that go with being a landlord.

    Yes, she would have to do an annual tax return I think.
