Argos return of carpet washer

I would imagine if you went back to Argos to claim it had already been changed once they would contact Vax for verification before refunding.0

OP, with the introduction of The Consumer Rights Act on 1st October 2015 you have the right to insist on a refund after one failed repair attempt.
The legislation does not explain how you convince the seller that one repair has already been attempted.
For the avoidance of confusion, 'repair' in this situation means 'making the goods conform to contract' and a replacement is one way of achieving that.0 -

Hi
Yesterday I took back to Argos with receipt a dirt devil carpet cleaner which I purchased on 10/10/15.
The fault was the roller brush motor had burnt out even though I have only used it 4 times.
So into Argos can't replace it needs to be fixed told me to contact vax! I refused told them that due to a house move I needed the cleaner now to clean my carpets ready for sale and when I move in, and that if a engineer was to come out and repair I wouldn't be able to arrange a address because I could be moved next week!
They said it could not be swapped and phoned vax for me who have said email proof of receipt and they will replace.. So I guess I'm getting a new one my concern is the following.
I purchased the cleaner from Argos as so my contract is with Argos when said new cleaner comes my receipt doesn't change because Argos have essentially washed there hands of me I want a returned receipt so to prove I have had issues and that the cleaner wasn't purchased on the 10/10/15 making it harder in the future if cleaner fails again?
What are my rights here? I thought Argos had to repair the item ie I return it they get it repaired then I collect? Dunno
Any help
You are correct, your contract is with Argos.
But as you have said, Argos have arranged for a free replacement for you (Argos don't produce or repair the item themself)
Where a repair or replacement occurs, the guarantee still only usually starts from the date of the original purchase. (Don't go hoping for future trouble, but if you strongly believe it will fail again in the same manner e.g. as a design fault, then resist the option to a repair or replacement)
Personally, I've never had a problem with returning a faulty item to Argos within 12 months (with the receipt). They either offer to replace (if available) or refund if no replacement is available. You can also usually sucessfully push for a refund even if they do offer a replacement, if that is what you would prefer.
But I don't go in shouting about my consumer rights etc. The few times I have had the necessity to return faulty goods, it would be clear the fault was not caused by mis-use etc. and I am entirely truthful about the matter.
So what do you think you may have done differently to me to not get the same service as I have obtained from various different Argos stores?0 -

How about answering the question rather than judging me based on what is just a internet argument?
I came here for help not to be god damn judged for stating what could be possible given the situation!
Bye
You came here to seek advice. No one here is paid to respoind to you, everyone is doing so out of their own time & willingness to assist you.
Unfortuinately, you may not like the advice you are being given, and therefore unwilling to accept it, but that does not detract from the value of that advice.
Your tone does not encourage others to assist you in this time of need, and with that I too will say "Bye" to you.0 -

(5)A consumer who has the right to a price reduction and the final right to reject may only exercise one (not both), and may only do so in one of these situations—
(a)after one repair or one replacement, the goods do not conform to the contract;
(b)because of section 23(3) the consumer can require neither repair nor replacement of the goods; or
(c)the consumer has required the trader to repair or replace the goods, but the trader is in breach of the requirement of section 23(2)(a) to do so within a reasonable time and without significant inconvenience to the consumer.
(6)There has been a repair or replacement for the purposes of subsection (5)(a) if—
(a)the consumer has requested or agreed to repair or replacement of the goods (whether in relation to one fault or more than one), and
(b)the trader has delivered goods to the consumer, or made goods available to the consumer, in response to the request or agreement.
Whether a repair/replacement carried out by the manufacturer under their own warranty would satisfy that condition remains to be seen, but I suspect not as the repair was provided under warranty and not necessarily because the goods failed to conform to contract. You keep using that word.
