Since when did the DVLA assume the right to make judgements over evidence, when by their own admission they don't get involved in ppc decisions. This advice should come from the trade body, and be in the COP surely, and is the usual DVLA tack!
I still think that if leaving site as TD says has such a detrimental or financial effect on the business, or land owners, it is the duty of the PPC to stop it happening, not watch it, log it, and try to pocket money for it after the event.
But of course challenging their apparent lack of due diligence in light of what the DVLA have said is a good call.0 -
As TD has already mentioned the company (via their staff) have a duty to mitigate their losses - if that is what they argue. It was at another Wickes location that the famous case of VCS -v- Ibbotson arose where an attendant simply observed a driver leaving site and issued a PCN. The judge asked why no attempt was made to prevent the driver leaving or at least advising him of the consequences of him doing so. It was during the hearing of the case that the judge also advised VCS's legal representative that she would need to bring her toothbrush with her if she persisted with a particular line.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

Well I have had an email from wickes customer service saying G24 have waivered the fine on this occasion!!!!! The store didn't want to know but I emailed their customer service and just got an email back. Thought you would want to know occasionally another route works. Thanks all for your help0

Could you let me know what email address you used for Wickes customer service? I have now heard back from the general customer service email and they have said there is nothing they can do to make G24 waive the fine. Seems strange as your circumstances are similar to mine (I entered the store to look at kitchens and paint samples but didn't purchase anything). Just wondering if I should try again.0 -

There is only one thing they are interested in, well, two actually.
Money and convincing their poor customers that they are managing something. The customers believe that they are managing their car parks when in reality all they are managing is emptying our pockets - and they've become quite adept at that when you look at the numbers of people who simply pay up.

The parking weasel has a duty to mitigate any loss which your non compliance might cause his/her employers. He could be summoned to court and questioned about such actions and what instructions he had received from them.
As Fisherjim says, this could be embarrassing for the PPC.
In addition, if it's a contractual charge for leaving the site - why doesn't the weasel go and collect it at the time instead of writing letters? Or why aren't there pay-on-exit gates?0
